6.24.110 OFFSITE MASSAGE <br /> A. Any Certified Massage Practitioner or Massage Technician seeking to offer, engage in, <br /> conduct, or carry on Offsite Massage shall file a written application with Police Chief on a form <br /> provided by the Police Department. <br /> B. It shall be unlawful for any Person to offer, engage in, conduct, or carry on Offsite <br /> Massage in a Massage Establishment, school of massage, residence, motor vehicle, trailer, in <br /> any manner as mobile Massage, or in any location not approved by the Police Chief or not in <br /> compliance with the Pleasanton Municipal Code. <br /> 6.24.120 NOTIFICATIONS. <br /> A. A Massage Business shall notify the Police Chief of any renewal or amendments <br /> described in subsections 6.24.090(B) and (C) pursuant to the timelines therein. <br /> B. A Massage Business and Massage Practitioner shall notify the Police Chief of any of the <br /> following within seventy-two (72) hours of the occurrence: <br /> 1. cessation of business as a Massage Business or Massage Practitioner <br /> practicing in the City of Pleasanton; <br /> 2. arrest of any Massage Business Owner, Massage Practitioner, Employee, or <br /> Independent Contractor for an offense other than a misdemeanor traffic offense; <br /> 3. resignation, termination, or transfer of any Massage Practitioner employed or <br /> hired by the Massage Business; <br /> 4. any matter or event involving the Massage Business or Massage Practitioner, <br /> employed or working for the Massage Business that constitutes a violation of this Chapter, state <br /> or federal law, or a violation of any law which would be grounds for denial, suspension, or <br /> revocation of a City Registration Permit or Massage Technician Permit; or <br /> 5. the denial, suspension, or revocation of a Massage Business's Employee's or <br /> Independent Contractor's certificate issued by the California Massage Therapy Council. <br /> C. This provision requires reporting to the Police Chief even if the Massage Business or <br /> Massage Practitioner believes that the Police Department has or may receive the information <br /> from another source. <br /> 6.24.130 REVOCATION AND SUSPENSION OF CITY REGISTRATION PERMIT <br /> A. Reasons for Revocation or Suspension. The Police Chief may revoke or suspend any <br /> permit granted under this Chapter if any of the following are found: <br /> 1. The permittee does not possess the qualifications for the permit as required by <br /> this Chapter; <br /> 2. The permittee has been convicted of any violation of any provision of this <br /> Chapter; <br /> 3. The permittee has engaged in, conducted, or operated in a manner which <br /> violates any provision of this Chapter, any conditions of a permit issued under this Chapter, or <br /> any laws which would have been grounds for denial of the permit; <br /> 4. There is fraud, material misrepresentation, false statement, or omission of a <br /> material fact in any application for a permit or in any supplementary material, amendment, or <br /> renewal of a permit related to this Chapter; <br /> 5. An activity authorized in the permit has been conducted in an unlawful manner or <br /> in such a manner as to constitute a menace to the health, safety, or general welfare of the <br /> public; <br /> 6. A certificate, permit, or license issued to a Massage Practitioner or Owner of a <br /> Massage Business in another jurisdiction has been denied, suspended, or revoked. <br /> 7. A Certified Massage Practitioner is no longer certified by the California Massage <br /> Therapy Council. <br /> 13 <br />
