THE CITY OF 17 <br /> «;31%11111'''''*' CITY COUNCIL AGENDA REPORT <br /> pLEASANTON <br /> September 3, 2019 <br /> Police <br /> TITLE: INTRODUCE AN ORDINANCE TO AMEND CHAPTER 6.24 MASSAGE OF <br /> THE PLEASANTON MUNICIPAL CODE AND REPEAL URGENCY <br /> ORDINANCES 2182 AND 2183 PROHIBITING THE ISSUANCE OF <br /> SPECIFIED APPROVALS AND PERMITS FOR NEW OR EXPANDED <br /> MASSAGE ESTABLISHMENTS IN THE DOWNTOWN SPECIFIC PLAN <br /> AREA <br /> SUMMARY <br /> The State of California enacted regulations that provide for local registration, permitting <br /> and regulation of massage businesses and practitioners to protect customer health and <br /> safety and curtail illicit activities. Pleasanton has regulated massage businesses <br /> through permitting since 1973. The attached proposed ordinance requires CAMTC <br /> certification for all massage practitioners providing massage in Pleasanton and phases <br /> out massage technician permits issued by the Police Department. The proposed <br /> ordinance retains city permitting of massage establishments through a newly named <br /> City Registration Permit. The proposed ordinance also enhances operating <br /> requirements and restrictions to protect the health and safety of customers and curtail <br /> unlawful activities such as prostitution and human trafficking. <br /> Finally, the ordinance repeals urgency ordinances 2182 and 2183 prohibiting the <br /> issuance of specified approvals and permits for new or expanded massage <br /> establishments in the Downtown Specific Plan Area. <br /> RECOMMENDATION <br /> It is recommended that the City Council (1) introduce an ordinance to amend Chapter <br /> 6.24 Massage of the Pleasanton Municipal Code and (2) repeal urgency ordinances <br /> 2182 and 2183 prohibiting the issuance of specified approvals and permits for new or <br /> expanded massage establishments in the Downtown Specific Plan Area. <br /> FINANCIAL STATEMENT <br /> The proposed ordinance retains the permitting $100 fee for massage establishments. <br /> The administrative costs to register CAMTC certified massage technicians are expected <br /> to be nominal but will be monitored. If registration and permitting costs are greater than <br /> expected, the Master Fee Schedule could be amended to recover them. <br />
