BACKGROUND <br /> The 2014 Parks and Recreation Master Plan identified the need to resurface the <br /> basketball courts in twelve City parks. The City of Pleasanton Parks Division staff then <br /> analyzed all basketball courts within these parks to prioritize the resurfacing. The courts <br /> at Meadowlark and Ken Mercer Sports Park were identified as being the most in need of <br /> repair. The two courts have significant issues with the court lines, acrylic surfacing and <br /> asphalt. <br /> The courts will be resurfaced using a slip sheet overlay system, which was determined <br /> to provide the best balance between cost and longevity in the City's 2017 analysis of <br /> resurfacing options. The slip sheet system has a minimal impact as it utilizes the <br /> existing asphalt as a base with a layered sheet system to provide a stable surface that <br /> has enough flexibility to bridge the cracks in the existing asphalt. The expected <br /> longevity of the slip sheet system is 20 to 25 years. <br /> The City prepared bid documents in June 2019 and advertised for construction bid in <br /> July 2019. <br /> DISCUSSION <br /> Two contractors submitted a bid for this project by the bid deadline of 2 p.m. on <br /> Wednesday, August 7, 2019. The Engineer's Estimate for the project was $126,800. <br /> The low bid amount of $118,570 was received from Guerra Construction Group <br /> (Guerra). Staff reviewed the low bid and found the contractor did not provide the <br /> experience with installing the slip sheet system documentation with their sealed bid as <br /> required. The omission of the documentation was discussed with Guerra to determine if <br /> they did have the requisite experience with installing the slip sheet overlay system. <br /> Guerra Construction Group then submitted a formal letter requesting to withdraw their <br /> bid, explaining they were unaware of the experience qualification requirements needed <br /> to perform the specialized work for the installation of the slip sheet overlay system <br /> (Attachment 2). <br /> According to California Public Contract Code, the City could award the project to Guerra <br /> for their low bid amount, and Guerra would be required to enter into the contract and <br /> attempt to perform the work. Alternately, Guerra could choose not to enter into the <br /> awarded contract and forfeit their 10 percent bid guarantee bond to offset the cost <br /> differential if the City then chose to award to the next lowest bidder. However, since <br /> Guerra does not possess the requisite experience, staff recommends accepting <br /> Guerra's withdrawal without penalty, and awarding the bid for the Basketball Court <br /> Resurfacing at Meadowlark and Ken Mercer Sports Park Project to the next lowest <br /> bidder, Vintage Contractors, Inc. in the amount of$155,570. <br /> Vintage has experience installing slip sheet systems in the Bay Area and has installed <br /> dozens of courts in Alameda County using the slip sheet system in the last few years, <br /> including the Pleasanton Middle School tennis courts in 2007, five tennis courts at <br /> Page 2 of 3 <br />
