THE CITY OF 6 CITY COUNCIL AGENDA REPORT pL£ASANTON, September 3, 2019 Community Development Planning Division TITLE: APPROVE AN AMENDMENT TO THE PROFESSIONAL SERVICES AGREEMENT WITH FIRSTCARBON SOLUTIONS (FCS) FOR THE PREPARATION OF AN ENVIRONMENTAL IMPACT REPORT (EIR) FOR PONDEROSA HOMES' HIDDEN CANYON/LESTER PROJECT, FOR AN ADDITIONAL $39,870 FOR A TOTAL CONTRACT AMOUNT NOT TO EXCEED $262,016. SUMMARY Staff is requesting an amendment to the previously approved professional services agreement with FirstCarbon Solutions (FCS) for preparation of an environmental impact report (EIR) for the Hidden Canyon Project. The project includes a 31-lot single family residential development and dedication of open space, on four properties totaling approximately 128.5 acres south of Dublin Canyon Road. A professional services agreement in the amount of $222,146 was approved by City Council on September 4, 2018. The amendment addresses additional work necessary to comply with new CEQA guidelines that went into effect in January 2019. The proposed amendment to the approved agreement would increase the agreement amount by $39,870 to a total of $262,016, which includes an approximately 12 percent contingency. RECOMMENDATION 1 . Authorize the City Manager to execute an amendment to the Professional Services Agreement with FCS for services related to preparation of an Environmental Impact Report, in an amount not to exceed a total of $262,016, in generally the form shown in Attachment 1 , subject to minor modifications approved by the City Manager and City Attorney. 2. Authorize the City Manager to execute an amendment to the reimbursement agreement with Ponderosa Homes for reimbursement of all costs associated with the amended professional services agreement with FCS, in generally the form shown in Attachment 2, subject to minor modifications approved by the City Manager and City Attorney. FINANCIAL STATEMENT The cost of the amendment to the professional services agreement would be paid by Ponderosa Homes. Planning Division review and administration will be conducted by staff and is part of the Current Planning budget.
