THE CITY OF 6 <br /> CITY COUNCIL AGENDA REPORT <br /> pL£ASANTON, <br /> September 3, 2019 <br /> Community Development <br /> Planning Division <br /> TITLE: APPROVE AN AMENDMENT TO THE PROFESSIONAL SERVICES <br /> AGREEMENT WITH FIRSTCARBON SOLUTIONS (FCS) FOR THE <br /> PREPARATION OF AN ENVIRONMENTAL IMPACT REPORT (EIR) FOR <br /> PONDEROSA HOMES' HIDDEN CANYON/LESTER PROJECT, FOR AN <br /> ADDITIONAL $39,870 FOR A TOTAL CONTRACT AMOUNT NOT TO <br /> EXCEED $262,016. <br /> SUMMARY <br /> Staff is requesting an amendment to the previously approved professional services <br /> agreement with FirstCarbon Solutions (FCS) for preparation of an environmental impact <br /> report (EIR) for the Hidden Canyon Project. The project includes a 31-lot single family <br /> residential development and dedication of open space, on four properties totaling <br /> approximately 128.5 acres south of Dublin Canyon Road. A professional services <br /> agreement in the amount of $222,146 was approved by City Council on September 4, <br /> 2018. The amendment addresses additional work necessary to comply with new CEQA <br /> guidelines that went into effect in January 2019. The proposed amendment to the <br /> approved agreement would increase the agreement amount by $39,870 to a total of <br /> $262,016, which includes an approximately 12 percent contingency. <br /> RECOMMENDATION <br /> 1 . Authorize the City Manager to execute an amendment to the Professional Services <br /> Agreement with FCS for services related to preparation of an Environmental Impact <br /> Report, in an amount not to exceed a total of $262,016, in generally the form shown in <br /> Attachment 1 , subject to minor modifications approved by the City Manager and City <br /> Attorney. <br /> 2. Authorize the City Manager to execute an amendment to the reimbursement <br /> agreement with Ponderosa Homes for reimbursement of all costs associated with the <br /> amended professional services agreement with FCS, in generally the form shown in <br /> Attachment 2, subject to minor modifications approved by the City Manager and City <br /> Attorney. <br /> FINANCIAL STATEMENT <br /> The cost of the amendment to the professional services agreement would be paid by <br /> Ponderosa Homes. Planning Division review and administration will be conducted by staff <br /> and is part of the Current Planning budget. <br />
