Resolution No. PC-2019-21 <br /> Page Five <br /> Section 3: Findings for Conditional Use Permit <br /> With respect to the approval of the Conditional Use Permit (Case P19-0332), the Planning <br /> Commission makes the following findings as required by Section 18.124.070 of the <br /> Pleasanton Municipal Code: <br /> 1. The location of the proposed conditional use is in accordance with the <br /> objectives of the zoning ordinance and the purpose of the district in which <br /> the site is located. <br /> The objectives of the Zoning Ordinance include fostering a harmonious, <br /> convenient, workable relationship among land uses, protecting land uses from <br /> inharmonious influences and harmful intrusions, promoting a safe, effective traffic <br /> circulation system, and ensuring that public and private lands ultimately are used <br /> for the purposes which are most appropriate and beneficial to the City as a whole. <br /> As conditioned, the proposed use would be consistent with these objectives. <br /> One purpose of the Commercial District is to provide opportunities for retail <br /> markets, offices, service establishments, amusement establishments, and <br /> wholesale businesses to concentrate for the convenience of the public and in <br /> mutually beneficial relationship to each other. The proposed uses would be <br /> operated on a site that currently allows commercial uses. The convenience store <br /> and fuel station are existing uses on the site. The proposed drive-through carwash <br /> would be compatible with the surrounding commercial and office uses. The <br /> convenience store would continue its 24-hour operation and alcohol sales will be <br /> limited to the hours of 6 a.m. to 2 a.m. per State law. The proposed carwash would <br /> operate from 7 a.m. to 10 p.m. The Planning Commission finds that the proposed <br /> hours of operation and uses would be compatible with the surrounding commercial <br /> businesses and would not impact nearby residential uses. The applicant will be <br /> required to mitigate any future nuisances which may occur as a result of the <br /> proposed use. <br /> 2. The proposed location of the conditional use and the conditions under which <br /> the conditional uses would be operated or maintained will not be detrimental <br /> to the public health, safety, or welfare, or materially injurious to the <br /> properties or improvements in the vicinity. <br /> The uses, as conditioned, would not be detrimental to the public health, safety, or <br /> welfare, or materially injurious to properties or improvements in the vicinity. The <br /> Project site has adequate vehicular access from Hopyard Road and W. Las Positas <br /> Boulevard. The proposed uses would not generate a substantial increase in peak <br /> hour trips thereby limiting impacts on the surrounding uses and the local roadway <br /> network. Additionally, the proposed Project would have the needed parking for <br /> patrons and employees. To help reduce noise levels, the proposed Project will be <br /> required to meet the recommendations identified in the noise assessment prepared <br /> by Illingworth & Rodkin, Inc. including the proposed carwash dryers and vacuum <br /> units utilizing quieter systems to ensure compliance with the City's Noise <br /> Ordinance.
