The proposed re-zoning from C-N to PUD-C would specify that a gas station combined with a <br /> convenience store and car wash would be a conditionally permitted use, to ensure the <br /> operation of the convenience market, self-service station and carwash would not cause <br /> adverse impacts to the community when operated in conjunction with one another. The <br /> applicant has accordingly applied for a conditional use permit, which as outlined below, would <br /> allow the City to condition the project so as to mitigate any potential future problems. Based <br /> on the above, staff believes that rezoning the site from the existing C-N District to PUD-C <br /> District is appropriate for this location. <br /> Operations <br /> The convenience store and self-service station would continue to operate 24 hours a day, <br /> seven days a week, the same as the existing hours, with the sale of alcoholic beverages (beer <br /> and wine) to be among the merchandise sold in the store. However, State law prohibits alcohol <br /> from being sold between 2 a.m. and 6 a.m. (per California Business and Professions Code <br /> Section 25631). As proposed, approximately 12-14 percent of the floor area would be devoted <br /> to the sale of alcohol. The drive-through carwash would be open from 7 a.m.-10 p.m. <br /> The proposed service station and convenience store with alcoholic beverage sales on the <br /> same site is not the first proposed or approved in the City. There are five existing service <br /> stations with convenience stores on the same site in the City offering beer and wine for sale: <br /> the Shell station located at 5251 Hopyard Road; the Chevron station located at <br /> 1797 Santa Rita Road; the Chevron station at Bernal Corners located at 1875 Valley Avenue; <br /> the American Gas station located at 3121 Bernal Avenue; and the Valero station located at <br /> 3912 Santa Rita Road. All of these service stations are located in PUD zoning districts and the <br /> PUD approvals allowed the operation of a service station and a convenience store with the <br /> sale of beer and wine on the same site. The Pleasanton Police Department confirmed with <br /> staff that these existing businesses have not generated significant issues related to the <br /> combination of alcohol sales and service stations on the same site. Staff believes that the <br /> proposed combined uses on the project site would also not create issues. <br /> Furthermore, the existing 7-Eleven convenience store with alcohol sales and the Shell station <br /> have been operating adjacent to each other for several decades. Having both uses on one site <br /> would not substantially differ from the existing condition. Therefore, staff believes having the <br /> proposed uses on one site is supportable. However, if the sale of alcohol from the convenience <br /> store were to become problematic, the Director of Community Development can refer the <br /> Conditional Use Permit to the Planning Commission for subsequent review at a public hearing. <br /> Staff has added conditions to the Conditional Use Permit addressing the sale of beer and wine <br /> from the convenience market (e.g., conformance to State law regarding alcohol sales hours <br /> and training for the convenience store operators in dealing with inebriated drivers). The <br /> applicant concurs with these requirements. <br /> Police Calls for Service <br /> Staff requested Calls for Service data1'1 from the Pleasanton Police Department between 2015 <br /> and 2018 at the project site. The data included a variety of reported incidents. The data <br /> showed a total of four service calls related to "robbery" over a four-year span at the existing <br /> [1] Calls for Service is a phone call log listing the number of calls that the Police Department receives. The nearest <br /> site address may be used to identify the location, which may not be the actual location of the reported incident. <br /> PUD-134/P18-0332/P18-0334 Planning Commission <br /> Page 16 of 24 <br />
