Attachment 2 <br /> MARINA; tt <br /> Still Growing <br /> landscape construction <br /> landscape maintenance <br /> 8/12/2019 landscape architecture <br /> erosion control <br /> City of Pleasanton — Department of Engineering design build <br /> 200 Old Bernal Avenue <br /> Pleasanton, California 94566 <br /> Mr. Matt Gruber <br /> Re: Bid Protest— Pioneer Cemetery Entry and Wayfinding Improvements Project No. 18750 <br /> Dear Sir, <br /> This letter is in response to the bid opening conducted on August 8,2019 at 2:00 PM for the subject <br /> project. <br /> On August 9, 2017 we received a complete copy of the bid documents submitted by Suarez & <br /> Munoz Construction, Inc. the apparent low bidder for the subject project, hereinafter referred to as <br /> Suarez. <br /> Upon review of the provided documents and in reference to the provisions of the Notice to Bidders, <br /> it appears that Suarez altered the bid form document for bid items#1 through #6, #I7 and#I8 by <br /> writing in the letters "LS" in lieu of providing a unit price by which the bid could be extended. <br /> Page 14 of the Instructions to Bidders `Modifications and Alternative Proposals' states that <br /> proposal forms are to be submitted `without interlineations, alterations or erasures' and that if <br /> found, this would be grounds for rejection and non-responsiveness of a submitted bid. <br /> Furthermore, page 15 of the Instructions to Bidders `Discrepancies in Proposals'states that In the <br /> event there is more than one bid item on a Bid Proposal form, the Bidder shall furnish a price for <br /> all items and failure to do so will render the Bid Proposal non-reponsive'.
