BACKGROUND
On March 19, 2019, as part of the 2019 LPFD Weed Abatement Program, the City
Council adopted Resolution No. 19-1069, which declared that weeds on specified
properties constituted a public nuisance, ordered the abatement thereof, and set a
public hearing to hear objections to the proposed abatement. On April 16, 2019, the City
Council adopted Resolution No. 19-1073, which ordered the abatement of weeds on the
parcels identified in Resolution No. 19-1069 and declared that the weed abatement
costs, including a 100% charge for administrative costs, are the responsibility of the
property owner.
This agenda report is the third and final agenda report to the City Council regarding the
2019 Weed Abatement Program. After the deadline of May 31, 2019, fire inspectors re-
surveyed the parcels for compliance. All but two parcels surveyed were compliant and
did not require abatement by the City contractor. A contractor hired by the City abated
the weeds and reduced the hazard on two (2) parcels which were noncompliant after
the May 31, 2019 deadline.
The Government Code provides that the abatement costs, including the administrative
costs for enforcement, are recoverable and constitute a special assessment against the
parcels that are abated. After the assessment is made, unless an exception applies, a
lien attaches on the parcel upon recordation of the order confirming the assessment and
the lien will be included on the property owner's regular tax bill for the parcel requiring
abatement. Property owners have until July 16, 2019 at 5:00 pm to pay the invoice to
avoid it being placed on their tax bill. An itemized report showing the cost of weed
abatement on a lot-by-lot basis throughout the City is attached to the resolution that
accompanies this agenda report.
DISCUSSION
Staff recommends that at this hearing, after considering any and all objections to the
proposed abatement, the City Council should overrule any objections to the proposed
abatement and/or move to amend the list of properties abated.
Submitted by: Fisc Review: Approved by:
li Jeff Peters Tina Olson Nelson Fialho
Fire Chief Director of Finance City Manager
Attachments:
1 .
