NG 91-5.22, of ARTIiCLE 2, CHAPTER 3, <br /> OF TITLE I, OF THE ORDINANCE CODE OF THE CITY OF PLEASANTO~, <br /> RELATZNG TO EXEMPTIONS UNDER THE BUSINESS LICENSE TAX <br /> <br />THE CITY COUNCIL 0F THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br /> <br /> I. <br /> <br /> Section 1-5.22 of Article 2, of Chapter 3, Title I, of the <br />Ordinance Code of the City of Pleasanton, relating to exemptions <br />from the Business License requirements of the City, is hereby <br />amended as follows: <br /> <br /> "§1-5.22 Exemptions. Nothing in this article shall be deemed <br /> or construed to apply to any person transacting and <br /> carrying on any business exempt by virtue of the <br /> Constitution or applicable statutes of the United <br /> States or of the State of California from the paymenti <br /> of such taxes as are herein prescribed, nor shall thei <br /> provisions of this article apply to any utility, <br /> public or private, which makes annual franchise <br /> payments to the City. <br /> <br /> Any person claiming an exemption pursuant to this <br /> section shall file a sworn statement with the Collec- <br /> tor stating the facts upon which exemption is claimed, <br /> and in the absence of such statement substantiating <br /> the claim, such person shall be liable for the pay- <br /> ment of the taxes imposed by this article. <br /> <br /> The Collector shall, upon a proper showing contained <br /> in the sworn statement, issue a license to such <br /> person claiming exemption under this section without <br /> payment to the City of the license tax required by <br /> this article. <br /> <br /> The Collector, after giving notice and a reasonable <br /> opportunity for hearing to a licensee, may revoke any <br /> license granted pursuant to the provisions of this <br /> section upon information that the licensee is not <br /> entitled to the exemption as provided herein." <br /> <br /> II. <br /> <br /> This Ordinance shall be published once within 15 days after its <br /> adoption in "THE TIMES", a newspaper of general circulation, pub- <br /> lished in the City of Pleasanton, and shall be in force on the <br /> thirty-first day after adoption. <br /> <br /> INTRODUCED at a regular meeting of the City Council of the City <br /> <br /> <br />
