RESOLUTION NO. 19-1101 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON AUTHORIZING <br /> THE CITY ENGINEER TO ACCEPT CERTAIN PUBLIC IMPROVEMENTS AS COMPLETE, <br /> AND TO DETERMINE WHEN TO REQUIRE PUBLIC IMPROVEMENT AGREEMENTS <br /> WHEREAS, the City Council has previously delegated authority to the City Engineer to <br /> accept deeds and grants conveying real property to the City in Resolution No. 11-425; and <br /> WHEREAS, the interests administrative efficiency can also be achieved by allowing the City <br /> Engineer to: (a) accept as complete certain public improvements which private developers build in <br /> conjunction with their small projects (for example, public water main along frontage of new single <br /> family home or minor subdivision), when such projects are not otherwise considered by the City <br /> Council for final acceptance or action (for example, a final vesting subdivision map); and (b) <br /> determine when private development projects require a public improvement agreement, thereby <br /> allowing some small projects not to need a public improvement agreement when the City Engineer <br /> determines in his or her reasonable professional judgment that other project inspections and permits <br /> provide adequate guarantees that required public improvements will be completed by the developer; <br /> and <br /> WHEREAS, this authority does not include acceptance of public streets or public roads, <br /> which authority remains with the City Council pursuant to California Streets and Highways Code <br /> §1806. <br /> NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br /> SECTION 1. Authorizes the City Engineer to: (A) accept as complete public improvements <br /> for private development projects which are not otherwise considered by the City Council for final <br /> acceptance pursuant to the Pleasanton Municipal Code or state law; and(B)to determine when private <br /> development projects are required to enter into a public improvement agreement if not otherwise <br /> required by the Pleasanton Municipal Code or state law. <br /> SECTION 2.
