SHADOW CLIFFS REGIONAL RECREATION AREA <br /> EAST BAY REGIONAL PARK DISTRICT <br /> AND <br /> CITY OF PLEASANTON <br /> LEASE AGREEMENT <br /> THIS AGREEMENT is made and entered into this 3+k- dayj ,jXr <br /> by and between the EAST BAY REGIONAL PARK of ,2004, <br /> of California, hereinafter called "Lessor," and the City of Pleasanton,T,a hereinafter cll iticalsubdivisioof <br /> " the Lesseee.."e <br /> S " <br /> WITNES SETH: <br /> THAT Lessor, for a good and valuable consideration and in further consideration of the faithful <br /> performance and observance by Lessee of all the terms and conditions herein contained,does hereby <br /> grant to Lessee a lease for the construction,reconstruction,maintenance,operation,removal and use <br /> of property for a BMX park operation only, together with the necessary appurtenances thereto, <br /> hereinafter referred to as "the BMX Park." <br /> THE LEASE above mentioned is granted by Lessor and accepted by Lessee upon the followin <br /> terms and conditions and Lessee does hereby agree with Lessor as follows: g <br /> 1. Definitions: <br /> As used in this Lease, "the BMX Park" shall refer to that property owned by the Lessor, <br /> located on Stanley Boulevard, as described on the legal description attached hereto as <br /> Exhibit "A," shown on the plat attached hereto as Exhibit "B," and shown on the map <br /> attached hereto as Exhibit "C". <br /> 2. Title of Lessor: <br /> Lessor warrants that is has legal title to the BMX Park. Lessee hereby acknowledges the title <br /> of Lessor in and to the BMX Park and agrees never to assail or to resist said title.
