Guidelines.The City Council further finds and certifies that it has reviewed and considered the information <br /> in the Draft EIR prior to adopting or approving any element of or entitlement for the Plan and that the <br /> Final EIR reflects the City Council's independent judgment. Similarly, the City Council finds that it has <br /> reviewed the record of proceedings and the Draft and Final EIR prior to approving any element of or <br /> entitlement for the Plan. By making these findings, the City Council confirms, ratifies and adopts the <br /> findings and conclusions of the Draft and Final EIR, as supplemented and modified by the findings <br /> contained herein. The Draft and Final EIR and these findings represent the independent judgment and <br /> analysis of the City and the City Council. <br /> The City Council further certifies that the Draft and Final EIR are adequate to support the <br /> approval/adoption of all Plan components. <br /> G. Mitigation Monitoring and Reporting Program <br /> A Mitigation Monitoring and Reporting Program (MMRP),which is included as Exhibit C,was prepared <br /> for the Plan and was adopted by the City Council by the same resolution that adopts these findings. (See <br /> Pub.Resources Code,4 21081.6,subd. (a)(1);CEQA Guidelines,4 15097.)The City will use the MMRP to <br /> ensure and track compliance with Plan mitigation measures. The MMRP will remain available for public <br /> review during the compliance period. <br /> H. Findings Required Under CEQA <br /> In accordance with Public Resources Code section 21081 and CEQA Guidelines sections 15091 and 15092, <br /> the City adopts the findings and conclusions regarding the impacts and mitigation measures that are set <br /> forth in the EIR.These findings do not repeat the full discussions of environmental impacts contained in <br /> the EIR. The City ratifies, adopts, and incorporates the analysis, explanation, findings, responses to <br /> comments, and conclusions of the EIR. The City adopts the reasoning of the EIR, staff reports, and <br /> presentations provided by the staff as may be modified by this Resolution. <br /> The City recognizes that the environmental analysis of the Plan raises controversial environmental issues, <br /> and that a range of technical and scientific opinion exists with respect to those issues.The City has,through <br /> review of the evidence and analysis presented in the record,considered the full scope of the environmental <br /> issues presented. These findings are based on a full appraisal of all viewpoints expressed and evidence <br /> presented in the EIR and in the record,as well as other relevant information in the record of the proceedings <br /> for the Plan. <br /> I. No Impact or Less than Significant Impacts Without Mitigation <br /> Based on the discussion in Section 3 of the Draft EIR,and other supporting information in the record,the <br /> City Council finds that the Plan would have no impact or a less than significant impact associated with the <br /> specific issues identified below.As a result,no mitigation measures were determined to be needed to address <br /> the following: <br /> 1. Aesthetics <br /> Implementation of the Plan would not have a substantial adverse effect on a scenic vista.
