Resolution No. PC-2019-09
Page Two
uses to the west; (2) adequate circulation to facilitate the anticipated on-site activities;
and (3) adequate on-site parking to support the use and anticipated number of persons
on-site at any given time. Additionally, the proposed use would not generate a
substantial increase in peak hour trips thereby limiting its impacts on the surrounding
uses and the local roadway network. The existing and proposed conditions of approval
give the City the appropriate controls to ensure that the use does not have any negative
impacts on the surrounding residences and businesses. The applicant would also be
required to mitigate any future nuisances that may occur as a result of the proposed
use.
B. That the proposed location of the conditional use and the conditions under which
it would be operated or maintained will not be detrimental to the public health,
safety, or welfare, or materially injurious to the properties or improvements in the
vicinity.
The subject parcel was previously occupied by similar uses from approximately 1982
until 2017 and the City is not aware of any reported issues related to these uses. If the
recommended conditions of approval are implemented, the proposed use will not
detrimentally affect surrounding uses because: (1) all exterior doors must remain closed
at all times during operating hours except during delivery truck loading/unloading
activities; (2) all delivery trucks must be parked with their engines turned off reducing
idling time; (3) no reverse beeping sounds would be permitted between the hours of
6:00 p.m. and 8:00 a.m.; (4) no outdoor storage would be permitted; and (5) no trash
would be dumped outside of the enclosed building area between the hours of
10:00 p.m. and 6:00 a.m. In addition, the proposed use will have adequate off-street
parking to meet project demand and all streets around the site are designed per City
standards to provide safe ingress and egress into and out of the site. The proposed
activities would also need to comply with the City's noise regulations, which were
designed to protect the peace, health, safety, and welfare of the residents and
businesses in the City. Conditions have also been included that would require the
applicant to mitigate any future nuisances as a result of the proposed use.
C. That the proposed conditional use will comply with each of the applicable
provisions of the zoning ordinance.
The site's I-P zoning conditionally permits the establishment of food-service warehouse
and distribution facilities within existing buildings. In addition, the proposed use
complies with all relevant sections of the zoning ordinance. Granting a CUP to the
proposed use would be consistent with the City's ability to regulate zoning as listed in
Municipal Code Chapter 18.124.
proval does not include approval of any signage for the Art of
Problem Solving Academy. If signs are desired, The Art of Problem Solving Academy
shall submit a sign proposal to the Planning Division for review and approval prior to sign
installation.
P19-0008 Planning Commission
r its passage and adoption
unless appealed prior to that time.
forfeited if the trees are destroyed or
substantially damaged.
