EXHIBIT A <br /> CONDITIONS OF APPROVAL <br /> P18-0109 <br /> 4112 Foothill Road <br /> April 24, 2019 <br /> The applicant is hereby notified, as part of this approval, that (s)he is required to satisfy and maintain <br /> compliance with the conditions of approval below. Where approval by the Director of Community <br /> Development, Planning Division, Director of Engineering/City Engineer, City Attorney, Chief Building <br /> and Safety Official, Fire Department or other City staff is required, review shall be for compliance with <br /> all applicable conditions of approval, adopted policies and guidelines, ordinances, laws and regulations, <br /> and accepted practices related to the approval. In addition to complying with the conditions below, the <br /> applicant is required to comply with all applicable federal, state, and local laws that pertain to this <br /> project whether or not specifically noted herein. <br /> This approval is granted to construct an approximately 7,104-square-foot residence with attached <br /> 850-square-foot garage and detached 1,200-square-foot Accessory Dwelling Unit on a vacant lot <br /> located on Assessor Parcel No. 941-2100-12 at 4112 Foothill Road. Development shall be substantially <br /> as shown on the project materials listed below: <br /> a. Project plans, Exhibit B, prepared by Diamond Design Studio for !shag & Sina Osman, dated <br /> "Received" on April 10, 2019 and kept on file in the Planning Division of the Community <br /> Development Department. <br /> b. Color and materials board prepared by Diamond Design Studio for lshaq & Sina Osman, dated <br /> July 12, 2018, and kept on file in the Planning Division of the Community Development <br /> Department. <br /> c. Arborist Report, prepared by HortScience, Inc. dated "Received" on December 18, 2018, and <br /> kept on file in the Planning Division of the Community Development Department. <br /> The project materials listed above are collectively the "Approved Plans." <br /> THIS APPROVAL IS GRANTED SUBJECT TO THE FOLLOWING CONDITIONS: <br /> 1. APPROVAL AND REVISIONS: The proposed development shall be in substantial conformance <br /> with the "Approved Plans", except as modified by the following conditions. Minor changes to the <br /> plans may be allowed subject to the approval of the Director of Community Development if <br /> found to be in substantial conformance with the approved exhibits. Planning Division approval is <br /> required before any changes are implemented in site design, grading, architectural design, <br /> house colors or materials, green building measures, landscape material, etc. <br /> 2. EXPIRATION — DESIGN REVIEW: This design review approval shall lapse 1 year from the <br /> effective date of approval unless a building permit is issued and construction has commenced <br /> and is diligently pursued towards completion, or the City has approved a time extension. <br /> 3. CONDITIONS OF APPROVAL CHECKLIST: The applicant shall submit a "Conditions of <br /> Approval Checklist" indicating all conditions in Exhibit A have been satisfied, incorporated into <br /> <br /> The proposed development will be visible from some vantage points on Foothill Road. <br /> However, once the proposed landscaping matures, the home will be substantially screened <br /> from view and will have limited visibility from Foothill Road. The Planning Commission finds the <br /> landscaping is designed to enhance architectural features, strengthen vistas, provide shade, <br /> and conform to established streetscape. <br />
