<br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON
<br /> DELEGATING AUTHORITY TO THE DIRECTOR OF ENGINEERING TO EXECUTE
<br /> GRANTS OF EASEMENT ASSOCIATED WITH TRACT 8352
<br /> WHEREAS, on January 5, 2016, the City Council adopted Ordinance No. 2133
<br /> approving PUD-25 (Tract 8352), a Planned Unit Development (PUD) application by Greenbriar
<br /> Homes Communities, Lund Ranch II, LLC, to subdivide the approximately 194.7-acre property
<br /> into 46 lots, including 43 lots for single-family homes and three lots (Parcels A, B, and C) to be
<br /> dedicated to the City of Pleasanton for permanent open space, and construct the Sunset Creek
<br /> Lane extension connecting the existing Sunset Creek Lane with the proposed development; and
<br /> WHEREAS, Greenbriar Homes Communities, Lund Ranch II, LLC and its successor, a
<br /> maintenance association to be created specifically for Tract 8352, will maintain the stormwater
<br /> treatment facilities located on Parcel B and the fire break area, which is coterminous with Parcel
<br /> A; and
<br /> WHEREAS, Greenbriar Homes Communities, Lund Ranch II, LLC and its successor, a
<br /> maintenance association to be created specifically for Tract 8352, will require access to operate
<br /> and maintain the stormwater treatment facilities located on Parcel B and to maintain the fire
<br /> break area within Parcel A;
<br /> WHEREAS, the necessary grants of easements and associated plats and legal
<br /> descriptions will be provided by Greenbriar Homes Communities, Lund Ranch II, LLC for filing
<br /> for record at the Alameda County Clerk-Recorder's Office prior to the City Council's acceptance
<br /> of public improvements associated with Tract 8352; and
<br /> WHEREAS, the City Council finds that private easements dedicated to Greenbriar
<br /> Homes Communities, Lund Ranch II, LLC and its successor, the maintenance association that
<br /> will be created specifically for Tract 8352, provides for the access needed for the Greenbriar
<br /> Homes Communities, Lund Ranch II, LLC and its successor to install, operate, maintain and
<br /> repair the stormwater treatment facilities and to maintain the fire break area, to serve Tract
<br /> 8352.
<br /> NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF
<br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER THE FOLLOWING:
<br /> SECTION 1. The City Council finds that the Greenbriar Homes Communities, Lund
<br /> Ranch II, LLC and its successor, the maintenance association that will be created specifically for
<br /> Tract 8352, need access to install, operate, maintain, and repair the stormwater treatment
<br /> facilities and to maintain the fire break area to serve Tract 8352.
<br /> SECTION 2. The City will dedicate private easements to Greenbriar Homes
<br /> Communities, Lund Ranch II, LLC and its successor, the maintenance association.
<br /> SECTION 3. The Director of Engineering is authorized to execute the grants of
<br /> easement and the City Clerk is directed to cause such documents to be recorded in the
<br /> Alameda County Clerk-Recorder's Office.
