ORDINANCE NO. 2190 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON APPROVING THE APPLICATION OF HENRY BATTEATE, FOR PLANNED UNIT DEVELOPMENT (PUD) DEVELOPMENT PLAN APPROVAL, AS FILED UNDER CASE PUD-131 WHEREAS, on August 2, 2018 Henry Batteate ("Applicant") applied for a PUD development plan approval under Case No. PUD-131 to construct a new approximately 5,059-square-foot single-family residence with an approximately 939-square-foot attached garage and convert the existing 1,016-square-foot residence to an Accessory Dwelling Unit ("Project") located at 481 Sycamore Road ("Property"); and WHEREAS, the Property is designated Low Density Residential in the General Plan; and WHEREAS, the Property is located in the North Sycamore Specific Plan area with a land use designation of PUD-A; and WHEREAS, on January 18, 2019, the Applicant resubmitted plans including modifications to the site design to retain additional trees on-site; and WHEREAS, on February 1, 2019, the application was deemed complete; and WHEREAS, on March 13, 2019, the Planning Commission, forwarded a recommendation of approval of the project to the City Council; and WHEREAS, on April 16, 2019 the City Council, following notification to the public in the prescribed manner, conducted a public hearing, where the application was on the consent calendar; and WHEREAS, the City Council considered the written agenda report, public testimony, related project materials, and staff recommendations; and WHEREAS, the proposed project is categorically exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to 15182, Projects Pursuant to a Specific Plan; and WHEREAS, after review of the materials presented, the City Council determined that the PUD plan is consistent with the General Plan, North Sycamore Specific Plan, and purposes of the PUD ordinance based on the considerations set forth in this ordinance. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1 The City Council finds that the project is exempt from further environmental analysis pursuant to Section 15182 because it is consistent with the North Sycamore Specific Plan and General Plan, and creates no new impacts. SECTION 2. With respect to the Planned Unit Development application, PUD-131, the City Council makes the following findings and determinations with respect to each of the considerations for approval of a PUD Development Plan as required by Section 18.68.110 of the Pleasanton Municipal Code (PMC):
