ATTACHMENT 3 <br /> RESOLUTION NO. <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> AUTHORIZING THE CITY ENGINEER TO ACCEPT CERTAIN PUBLIC <br /> IMPROVEMENTS AS COMPLETE, AND TO DETERMINE WHEN TO REQUIRE <br /> PUBLIC IMPROVEMENT AGREEMENTS <br /> WHEREAS, the City Council has previously delegated authority to the City Engineer to <br /> accept deeds and grants conveying real property to the City in Resolution No. 11-325; and <br /> WHEREAS, the interests administrative efficiency can also be achieved by allowing the <br /> City Engineer to: (a) accept as complete certain public improvements which private developers <br /> build in conjunction with their small projects (for example, public water main along frontage of <br /> new single family home or minor subdivision), when such projects are not otherwise considered <br /> by the City Council for final acceptance or action (for example, a final vesting subdivision map); <br /> and (b) determine when private development projects require a public improvement agreement, <br /> thereby allowing some small projects not to need a public improvement agreement when the <br /> City Engineer determines in his or her reasonable professional judgment that other project <br /> inspections and permits provide adequate guarantees that required public improvements will be <br /> completed by the developer; and <br /> WHEREAS, this authority does not include acceptance of public streets or public roads, <br /> which authority remains with the City Council pursuant to California Streets and Highways Code <br /> §1806. <br /> NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br /> SECTION 1. Authorizes the City Engineer to: (A) accept as complete public <br /> improvements for private development projects which are not otherwise considered by the City <br /> Council for final acceptance pursuant to the Pleasanton Municipal Code or state law; and (B) to <br /> determine when private development projects are required to enter into a public improvement <br /> agreement if not otherwise required by the Pleasanton Municipal Code or state law. <br /> SECTION 2. This resolution shall become effective immediately upon its passage and <br /> adoption. <br /> PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at <br /> a regular meeting held on May 21, 2019. <br /> I, Karen Diaz, City Clerk of the City of Pleasanton, California, certify that the foregoing <br /> resolution was adopted by the City Council at a regular meeting held on May 21, 2019, by the <br /> following vote: <br /> Ayes: <br /> Noes: <br /> Absent: <br /> Abstain: <br />
