ATTACHMENT 3 RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON AUTHORIZING THE CITY ENGINEER TO ACCEPT CERTAIN PUBLIC IMPROVEMENTS AS COMPLETE, AND TO DETERMINE WHEN TO REQUIRE PUBLIC IMPROVEMENT AGREEMENTS WHEREAS, the City Council has previously delegated authority to the City Engineer to accept deeds and grants conveying real property to the City in Resolution No. 11-325; and WHEREAS, the interests administrative efficiency can also be achieved by allowing the City Engineer to: (a) accept as complete certain public improvements which private developers build in conjunction with their small projects (for example, public water main along frontage of new single family home or minor subdivision), when such projects are not otherwise considered by the City Council for final acceptance or action (for example, a final vesting subdivision map); and (b) determine when private development projects require a public improvement agreement, thereby allowing some small projects not to need a public improvement agreement when the City Engineer determines in his or her reasonable professional judgment that other project inspections and permits provide adequate guarantees that required public improvements will be completed by the developer; and WHEREAS, this authority does not include acceptance of public streets or public roads, which authority remains with the City Council pursuant to California Streets and Highways Code §1806. NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: SECTION 1. Authorizes the City Engineer to: (A) accept as complete public improvements for private development projects which are not otherwise considered by the City Council for final acceptance pursuant to the Pleasanton Municipal Code or state law; and (B) to determine when private development projects are required to enter into a public improvement agreement if not otherwise required by the Pleasanton Municipal Code or state law. SECTION 2. This resolution shall become effective immediately upon its passage and adoption.
