ATTACHMENT 2 <br /> RESOLUTION NO. <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> AUTHORIZING THE CITY ATTORNEY TO SETTLE MATTERS INVOLVING FINES FOR <br /> ADMINISTRATIVE CITATIONS, AND COST RECOVERY FOR DAMAGE OF CITY <br /> PROPERTY AND FOR EMERGENCY RESPONSE <br /> WHEREAS, the City Council has previously delegated authority to the City Manager in <br /> Municipal Code Chapter 2.08 for the efficient administration of all the affairs of the City, as well <br /> as to the City Manager and City Attorney for settlement of government claims and workers <br /> compensation claims pursuant to Resolution No. 12-555; and <br /> WHEREAS, the interests of justice and administrative efficiency can also be achieved by <br /> the settlement of: fines levied for administrative citations issued for violations of the Pleasanton <br /> Municipal Code (PMC) pursuant to PMC Chapter 1.24; cost recovery for damage of city <br /> property; and cost recovery for emergency response pursuant to California Government Code <br /> §53150; and <br /> WHEREAS, California Government Code §949 authorizes the City Council to delegate to <br /> its attorney or an employee the authority to settle or compromise any pending action. <br /> NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br /> SECTION 1. Authorizes the City Attorney, in the reasonable interests of justice and <br /> administrative efficiency, to settle or compromise: fines levied for administrative citations issued <br /> for violations of the Pleasanton Municipal Code (PMC) pursuant to PMC Chapter 1.24; cost <br /> recovery for damage of city property; and cost recovery for emergency response pursuant to <br /> California Government Code §53150, in an amount up to $15,000. In addition, the City Attorney, <br /> with advice and consent of the City Manager, is authorized to compromise or settle the same <br /> matters for amounts between $15,001 and $50,000. <br /> SECTION 2. This resolution shall become effective immediately upon its passage and <br /> adoption. <br /> PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at <br /> a regular meeting held on May 21, 2019. <br /> I, Karen Diaz, City Clerk of the City of Pleasanton, California, certify that the foregoing <br /> resolution was adopted by the City Council at a regular meeting held on May 21, 2019, by the <br /> following vote: <br /> Ayes: <br /> Noes: <br /> Absent: <br /> Abstain: <br />
