• Possessing a valid California seller's permit for sales tax compliance; <br /> • Requiring additional licenses from other state or local agencies as required by <br /> law; <br /> • Requiring compliance with other generally applicable laws; and <br /> • Providing information on vendor operations. <br /> Proposed Ordinance <br /> The proposed ordinance requires sidewalk vendors to pay a nonrefundable processing <br /> fee and obtain a permit from the Police Department. In order to obtain a permit, <br /> applicants must also provide: (1) proper identification; (2) a copy of a valid California <br /> Department of Tax and Fee Administration seller's permit; (3) a copy of a valid Mobile <br /> Food Facility Permit issued by the Alameda County Department of Environmental <br /> Health; and (4) proof of insurance. All sidewalk vendors must have a City Business <br /> License. In order to cover the costs required to process such permits, staff is <br /> recommending establishing a sidewalk vendor fee in the amount of $50.00. <br /> The proposed ordinance also establishes various general requirements in order to <br /> ensure that sidewalks remain accessible to all pedestrians and that sidewalk vendors <br /> maintain and operate their equipment in a safe and clean way. <br /> Under the proposed ordinance, sidewalk vending is limited to the following locations and <br /> times: <br /> • Sidewalk vending hours limitations in areas zoned for nonresidential use will be <br /> as restrictive as any limitations on hours of operation imposed on other <br /> businesses or uses on the same street, excluding those permitted to operate 24 <br /> hours. <br /> • Sidewalk vending is limited to the hours of 9:00 a.m. through 5:00 p.m. for areas <br /> that are exclusively residential. <br /> • Stationary sidewalk vendors are prohibited from operating in areas that are <br /> exclusively residential. <br /> • A stationary sidewalk vendor is prohibited from operating in a City park if the City <br /> has entered into exclusive agreements for the sale of food or merchandise by <br /> one or more concessionaires for that City park. <br /> • A sidewalk vendor is prohibited from operating within five hundred (500) feet of: <br /> (1) a school; (2) a permitted certified farmers' market; (3) a permitted swap meet; <br /> or (4) any area subject to a parade permit or special event street closure permit <br /> or a temporary use permit. <br /> Page 3 of 4 <br />
