Cathy Gabor agreed with permitting electric meters only as a last-resort and asked whether the proposed new nodes would be on public poles/streets, the process for dealing with poles that are insufficient to handle the equipment and the expected start date for installing the equipment. Andrew Shotland expressed concerns regarding unknown health impacts and suggested asking Congress for an independent study to get a better idea of the health implications related to this matter. Mr. May reported most of the nodes will be located on existing infrastructure and most will be in the public rights-of-way. Furthermore, the applicant would pay to replace insufficient structures and reported the rollout of these types of facilities has begun in other cities. Vice Mayor Brown closed the public hearing. Councilmember Pentin acknowledged health issues and addressed preparing for the rollout of 5G technology. He commended staff for the report and expressed his support for the item. Councilmember Narum asked about the licensing agreement relative to the fees the City can charge and the market value of the poles. Mr. May reported the City can recover reasonable, direct costs. Councilmember Testa agreed with Mr. Shotland's comments regarding asking Congress for an independent study noting residents want to know that everything has been done to assure public safety. City Manager Fialho reported direction may be added to the next item for staff to contact Congressman Swalwell about a potential study on the effects of cell facilities. Councilmember Narum agreed and noted members of the public can contact their Congressman as well. Vice Mayor Brown commented on the need to comply with Federal and State laws and this ordinance will give staff added control. Brief discussion followed regarding the need to comply with ADA regulations, noting it could be grounds for denial if they are not complied with. MOTION: It was m/s by Pentin/Narum to adopt and waive full reading of Urgency Ordinance No. 2188 amending Chapter 18.110 of the Pleasanton Municipal Code establishing regulations for small wireless facilities pursuant to applicable Federal law; and adopted and waived full reading of Resolution No. 19-1066 adopting a Council Policy regulating small wireless facilities pursuant to Pleasanton Municipal Code Chapter 18.110.
