RESOLUTION NO. 19-1078 A RESOLUTION OF THE CITY COUNCIL OF PLEASANTON OPPOSING, UNLESS AMENDED, CALIFORNIA STATE SENATE BILL 50 — WIENER. PLANNING AND ZONING: HOUSING DEVELOPMENT: INCENTIVES WHEREAS, in December 2018, State Senator Scott Wiener introduced Senate Bill 50 which will greatly undermine locally adopted General Plans, Housing Elements, and Sustainable Community Strategies by allowing developers to override state approved housing plans; and WHEREAS, Senate Bill 50 gives housing developers and transit agencies power to determine housing densities, heights up to 55 feet, parking requirements, and design review standards for transit-rich housing projects within one-half mile of a major transit stop; and WHEREAS, Senate Bill 50 provides no protection to cities with downtown districts that are historic in nature; and WHEREAS, the City of Pleasanton has consistently addressed local and regional housing needs in a manner that respects its local community character; and WHEREAS, the City of Pleasanton has an interest in maintaining local control of decision-making related to all aspects of the management of the local jurisdiction, including but not limited to financial, land use and development, and growth-related matters; and WHEREAS, the City of Pleasanton Legislative Framework promotes the guiding principle for housing to support legislation that: (a) seeks balanced solutions which consider housing, jobs, and transportation together; (b) promotes and protects affordability in the housing stock; (c) is context-sensitive and does not take a one size fits all approach; (d) allows the City to exercise its local control developing locally-appropriate plans that meet State objectives in a manner that is compatible with existing community character; and (e) provides funding and resources for infrastructure and services in tandem with new housing production mandates. NOW, THEREFORE BE IT RESOLVED THAT THE PLEASANTON CITY COUNCIL DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: SECTION 1. Joins with other jurisdictions and a growing statewide coalition of housing advocates in opposing Senate Bill 50, unless amended to cure these concerns. SECTION 2. Affirms its interest in and commitment to shaping housing policy outcomes in a constructive manner that will result in better outcomes for the region and the individual communities.
