Draft Resolution and Conditions of Approval <br /> B. Project Plans dated "Received April 5, 2019" <br /> C. Zoning Administrator's Approval of PUD-80-16-17M <br /> D. Location and Notification Map <br /> STAFF RECOMMENDATION <br /> Staff recommends the Planning Commission approve Conditional Use Permit (CUP) Case No. <br /> P19-0008, based on the findings and subject to the draft conditions of approval in Exhibit A. <br /> EXECUTIVE SUMMARY <br /> The applicant requests CUP approval to operate a tutoring facility for up to 72 students at <br /> certain times at 5200 Franklin Drive, Suite 110. Tutoring facilities with more than 20 students <br /> on-site at a time require Planning Commission review and approval of a CUP. As proposed <br /> and conditioned, staff finds the use is consistent with the intent of the General Plan and <br /> objectives of the zoning district and will be compatible with the surrounding uses, and therefore <br /> recommends approval of the CUP. <br /> BACKGROUND <br /> The project site is located on the northwest corner of Franklin Drive and Johnson Drive in a <br /> PUD-I/C-O District. It is a part of a multi-parcel Planned Unit Development (PUD) approved <br /> under Case No. PUD-80-16. The approval allowed and conditionally allowed a wide range of <br /> uses in the PUD, including offices, warehousing, manufacturing, health clubs and daycare <br /> centers. Prior to excavation for the demolition and construction the tree may require root pruning <br /> outside the TREE PROTECTION ZONE by cutting all roots cleanly to the depth of <br /> construction.
