PC-2018-11 <br /> A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br /> APPROVING CONDITIONAL USE PERMIT AND DESIGN REVIEW APPLICATIONS FOR <br /> CHABAD OF THE TRI-VALLEY LOCATED AT 3370 HOPYARD ROAD <br /> AS FILED UNDER CASE: NOS. P16-0288 and P16-1883 <br /> WHEREAS, on February 10, 2016 Chabad of the Tri-Valley applied for a Conditional Use <br /> Permit to operate a religious institute with a childcare facility/preschool at 3370 <br /> Hopyard Road; and <br /> WHEREAS, zoning for the property is Multi Family Residential-2,500 (R-M-2,500); and <br /> WHEREAS, the proposed project is categorically exempt from the requirements of the <br /> California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines <br /> Section 15301, Existing Facilities, Class 1; and <br /> WHEREAS, at a duly noticed public hearing on April 25, 2018, the Planning Commission took <br /> public testimony, requested additional information on some items to be provided, <br /> suggested the applicant conduct additional outreach to neighbors, including a <br /> neighborhood meeting, and continued the public hearing; and <br /> WHEREAS, at a duly noticed public hearing on June 27, 2018, the Planning Commission <br /> considered all public testimony, directed the applicant relevant exhibits, and <br /> recommendations of the City staff concerning this application; and <br /> NOW, THEREFORE BE IT RESOLVED by the Planning Commission of the City of <br /> Pleasanton, based on the entire record of proceedings; including the oral and written agenda <br /> reports and all public comment and testimony: <br /> Section 1: Findings for Chabad of the Tri-Valley Conditional Use Permit <br /> With respect to the Chabad of the Tri-valley Conditional Use Permit, the Planning Commission <br /> makes the following findings as required by Section 18.124.070 of the Pleasanton Municipal <br /> Code: <br /> A. Thatthe proposed location of the conditional use is in accordance with the objectives of <br /> the zoning ordinance and the purpose of the district in which the site is located. <br /> Some of the objectives of the zoning ordinance are to: foster a harmonious, convenient, <br /> workable relationship among land uses, protect existing land uses from inharmonious <br /> influences and harmful intrusions, and ensure that public and private lands ultimately <br /> are used for the purposes which are most appropriate and beneficial to the City as a <br /> whole. The project site is located within a multi-family residential district which, per <br /> PMC Section 18.36.010) is intended to achieve various purposes including: providing <br /> spaces for semi-public facilities needed to complement urban residential areas and <br /> space for institutions that require a residential environment; to provide necessary space. <br /> for off-street parking of automobiles; and to protect residential properties from noise, <br />
