AND LIVERMORE <br /> July 9, 2018 <br /> This letter is an accompaniment to Chabad of the Tri Valley's application to appeal the <br /> June 27, 2018 decision of the Pleasanton Planning Commission. <br /> More specifically, this appeal is focused upon the harsh and burdensome restrictions <br /> the Planning Commission has imposed upon Chabad of the Tri Valley. <br /> - Each of these restrictions imposes a substantial burden} on the religious exercise <br /> of Chabad of the Tri Valley's religious rights and hinders its ability to serve the <br /> Jewish community. <br /> - As indicated on page 4 and 6 of the June 27, 2018 Planning Commission <br /> Agenda Report, no other House of Worship or preschool in Pleasanton has these <br /> restrictions. <br /> - Each of these restrictions is a violation of RLUIPA, Federal Statute 42 U.S. <br /> Code § 2000cc - Protection of Land Use as Religious Exercise. <br /> These conditions include: <br /> Condition #3: restricts the number of events outdoors to 15 and narrowly limits <br /> those events to those identified in Exhibit D regardless of the <br /> number and nature of religious events this Jewish Community <br /> may want hold at its synagogue. <br /> Condition #4: restricts the number of persons inside an outside the building to <br /> 120 regardless of how many Jewish people may want to attend <br /> religious activities at the synagogue. <br /> 3370 1-lopyard Road ♦Pleasanton,CA 94588♦ (925)846-0700♦www jewishTriVallcy.com <br />
