We are requesting that the City Council review the June 27,2018 decision of the Planning Commission <br /> regarding the Chabad CUP for the following substantial reasons. <br /> 1. The building originally constructed by the Masons, and now owned by Chabad,is an atypical <br /> situation. It was placed as the second building on a lot only designed for one building. As such,it <br /> creates a significant increase in potential activity and so is not a normal building to be used the same <br /> way as other structures. To protect the neighbors from activities generated by this building,the 1977 <br /> Planning Commission prohibited outdoor activity at the site. The 2018 Planning Commission's decision <br /> violates the conditions placed on the nature of this site from its inception. <br /> 2. The Planning Commission has ignored the level of noise that will be generated by the <br /> playground. An objective analysis by a sound engineer hired by the Millers indicates that the noise from <br /> the playground will be at least 20 dB above the ambient noise level. Five dB is the industry threshold for <br /> a significant increase in noise. The playground will increase ambient noise far above this level. <br /> 3. The Planning Commission approved additional outdoor activities,specifically large events of up <br /> to 120 people and smaller gathers of up to 24 people,with no assessment of the noise impact. These <br /> additional outdoor activities may generate similar and in some cases higher levels of noise than the <br /> playground. <br /> 4. The Planning Commission has failed to consider the accumulated impact of interjecting three <br /> new noise sources at the site,creating noise for extended periods of time virtually all day long and every <br /> day of year,that is,24/7/365. <br /> 5. The Planning Commission has failed to justify its statement that the dramatic increase in noise <br /> allowed by the new CUP will not be detrimental. Not only is the statement unsupported, but all the <br /> objective evidence proves the statement is incorrect. Scientific studies,numerous complaints by the <br /> neighbors,and the petition by the residents around the building that the noise is harmful to them all <br /> disprove the Planning Commission's claims. <br /> 6. The Planning Commission granted permission for social activities that have no apparent <br /> outdoor religious requirement. <br /> 7. The Planning Commission has ignored,and in fact reversed,the City Council's clear and <br /> unanimous decision prohibiting outdoor activity at this site and the 40 year history of limitations on this <br /> site. The decision of unelected officials should not override the decision of elected officials who are the <br /> highest authority in the City. <br />
