The appeal was scheduled to return to the City Council meeting on February 19, 2019. <br /> After the publication of the Council agenda report, both appellants, Darlene and Michael <br /> Miller, and Chabad of the Tri-Valley requested a continuance of the hearing, citing <br /> scheduling conflicts. As agreed by both appellants, the appeal is scheduled for the <br /> Council on April 16, 2019. <br /> The analysis in this Agenda Report addresses the issues raised at the August 21, 2018 <br /> City Council meeting and subsequently by St. Clare's. <br /> Since the date of the previously scheduled hearing, Chabad has submitted a revised <br /> site plan and requested it be included as part of the agenda report. This revised site <br /> plan is included as Attachment 4. Staff notes this site plan differs significantly from the <br /> site plan included in the current application, and has not been subject to the detailed <br /> public, staff, or Planning Commission review that could support any specific <br /> recommendation on the proposal. As such, and as outlined at the end of this report, <br /> staff suggests that, if Chabad wishes to pursue this proposed plan, that it be formally <br /> submitted as a new or amended project application. <br /> RECOMMENDATION <br /> Staff recommends that the City Council adopt a resolution denying both appeals, <br /> thereby upholding the Planning Commission's approval with modified conditions of <br /> approval and making the Conditional Use Permit contingent on Chabad recording an <br /> agreement on the property between Chabad and St. Clare's Episcopal Church allowing <br /> for shared parking on a portion of the property. <br /> FINANCIAL STATEMENT <br /> No fiscal impact. <br /> Page 2 of 14 <br />
