reconfiguration of these site elements, or of the parking lot or proposed church buildings <br /> may be necessary. <br /> Condition No. 3 of the St. Clare's Conditional Use Permit requires Planning Commission <br /> design review of the Phase Il improvements, which would be an opportunity for <br /> adjustments in the building(s) and parking lot(s) location or configuration to be reviewed <br /> and approved. Provided that Chabad's uses and overall site plan remain generally <br /> consistent with the current proposal and that contemplated in the St. Clare's Master <br /> Plan, staff suggests these could be reviewed and approved at the staff level. <br /> St. Clare's has indicated that they do not expect to move forward with their expansion <br /> for at least five years, which will allow time for Chabad to operate within the parameters <br /> of their project as approved, before having to contemplate revisions to it. <br /> Trash Enclosure <br /> St. Clare's letter also pointed that the Chabad is currently using St. Clare's trash <br /> enclosure to house their refuse containers, and that new mandatory recycling <br /> requirements will likely mean that St. Clare's will need to use the entire enclosure to <br /> house their required trash and recycling bins. Staff recognizes this concern, and as <br /> such, has included a condition of approval that will require Chabad to construct its own <br /> trash enclosure, unless an agreement can be reached between the two parties to <br /> construct, use and maintain a shared enclosure. <br /> Chabad Revised Site Plan <br /> On February 11, 2019, Chabad submitted a revised site plan that includes a <br /> reconfigured and enlarged outdoor patio area to the west of the building; a <br /> contemplation garden; and series of storage sheds to be located within the buffer area <br /> to the north. This revised plan is included as Attachment 3. <br /> This plan differs considerably from the current application, which has been extensively <br /> analyzed and vetted through the staff, Planning Commission and public review process. <br /> Should the applicant wish to proceed with this revised plan, staff recommends that it be <br /> formally submitted as either a new or amended project application, which would allow <br /> for a detailed analysis in light of all of the considerations and required findings for <br /> approval, and for public review and comment. No other specific recommendation on the <br /> revised plan is being made to the City Council at this time. Note that, irrespective of the <br /> City Council's action on the two appeals (i.e. whether it resulted in approval or denial of <br /> the application), the applicant could submit a new or amended application. <br /> Page 12 of 14 <br />
