(a) Applicable Facilities. Except as expressly provided otherwise in this Policy, the <br /> provisions in this Policy shall be applicable to all existing small wireless facilities <br /> and all applications and requests for authorization to construct, install, attach, <br /> operate, collocate, modify, reconstruct, relocate, remove or otherwise deploy small <br /> wireless facilities within the public rights-of-way or on private property within the <br /> City's jurisdictional and territorial boundaries. <br /> (b) Small Cell Permit. A "small cell permit," subject to the Community Development <br /> Director's prior review and approval, is required for any small wireless facility <br /> proposed on an existing, new or replacement structure. <br /> (c) Request for Approval Pursuant to Section 6409. Notwithstanding anything in <br /> the Policy to the contrary, requests for approval to collocate, replace or remove <br /> transmission equipment at an existing wireless tower or base station submitted <br /> pursuant to Section 6409 will be subject to the current FCC rules and regulations <br /> "eligible facilities requests" as defined by FCC and as may be amended or <br /> superseded. <br /> (d) Other Permits and Approvals. In addition to a small cell permit, the applicant <br /> must obtain all other permits and regulatory approvals as may be required by any <br /> other federal, state or local government agencies, which includes without limitation <br /> any ministerial permits and/or other approvals issued by other City departments or <br /> divisions. All applications for ministerial permits submitted in connection with a <br /> proposed small wireless facility must contain a valid small cell permit issued by the <br /> City for the proposed facility. Any application for any ministerial permit(s) submitted <br /> without such small cell permit may be denied without prejudice. Furthermore, any <br /> small cell permit granted under this Policy shall remain subject to all lawful <br /> conditions and/or legal requirements associated with such other permits or <br /> approvals. <br /> SECTION 2.2. SMALL CELL PERMIT APPLICATION REQUIREMENTS <br /> (a) Small Cell Permit Application Contents. All applications for a small cell permit <br /> must include all the information and materials required in this Section 2.2(a). <br /> (1) Application Form. The applicant shall submit a complete, duly executed small <br /> cell permit application on the then-current form prepared by the Community <br /> Development Director. <br /> (2) Application Fee. The applicant shall submit the applicable small cell permit <br /> application fee established by City Council resolution. Batched applications <br /> must include the applicable small cell permit application fee for each small <br /> wireless facility in the batch. If no small cell permit application fee has been <br /> established, then the applicant must submit a signed written statement that <br /> acknowledges that the applicant will be required to reimburse the City for its <br /> 5 <br />
