TERMINATION FOR CAUSE <br /> If the City finds the Property Owner has not complied in a material respect with the terms <br /> and conditions of this Agreement, the City shall provide written notice to the Property Owner <br /> describing: (1) such failure to comply with the terms and conditions of the Agreement <br /> ("Default"); and (2)the actions required by the Property Owner to cure such Default. The <br /> Property Owner shall have 60 days after the date of such notice to cure the Default or, if the <br /> Default is such that it cannot be cured within the 60 day period,the Property Owner shall have <br /> commenced the actions necessary to cure such Default and shall be diligently proceeding to <br /> complete such actions necessary to cure such Default within 60 days from the date of the notice. <br /> The Property Owner's failure to cure or pursue the cure of the Default as set forth above shall <br /> constitute grounds for termination of this Agreement. Unless replaced by a successor agreement, <br /> the termination of this Agreement shall result in the immediate applicability of the Mobilehome <br /> Ordinance to the Park. <br /> XIII. ATTORNEY'S FEES <br /> In the event that it becomes necessary for any party to bring a lawsuit to enforce any of <br /> tire provisions of this Agreement, a court of competent jurisdiction may determine and fix a <br /> reasonable attorney's fee to be paid the prevailing party. <br /> XIV. BINDING ON SUCCESSORS <br /> This Agreement is binding on the heirs, successors, and assigns of the parties hereto. <br /> XV. AMENDMENT <br /> This Agreement may be amended, modified, or changed by the parties if in writing and <br /> approved by all parties. <br /> XVI. MOBILEHOME RESIDENCY LAW <br /> Nothing in this Agreement shall preclude the Property Owner from entering into long- <br /> term leases, imposing any charges on Residents for governmental fees and assessments, utilities, <br /> and incidental reasonable charges for services actually rendered pursuant to the state <br /> Mobilehome Residency Law(Civil Code, sections 798 through 799.11). <br /> 021538.0001\5359154.1 7 <br />
