THE CITY OF 2 <br /> ::r: -• °°' =r ' "` CITY COUNCIL AGENDA REPORT <br /> pLE ASANTON <br /> March 11, 2019 <br /> City Manager <br /> TITLE: CONSIDER TAKING A CITY COUNCIL POSITION SUPPORTING H.R. 530 — <br /> ACCELERATING BROADBAND DEVELOPMENT BY EMPOWERING <br /> LOCAL COMMUNITIES ACT OF 2019 <br /> SUMMARY <br /> In August and September 2018, the FCC adopted regulations limiting the authority of <br /> cities and states to regulate wireless technological attachments to public infrastructure <br /> (e.g., street light and utility poles) needed for the deployment of 5G, the next generation <br /> of mobile internet technology. Regulations affecting review periods and fees took effect <br /> on January 14, 2019. Regulations affecting aesthetics will take effect on April 15, 2019. <br /> In response to these regulations, and the impacts they would have on communities and <br /> local governments, House Representative Anna Eshoo introduced a bill in Congress <br /> H.R. 530 Accelerating Broadband Development by Empowering Local Communities Act <br /> of 2019 on January 14, 2019 which, if passed, would deem those regulations to have no <br /> force and effect. <br /> The new FCC adopted regulations conflict with the City's position regarding protecting <br /> local control and is being brought to the City Council to consider taking a formal position <br /> supporting H.R. 530 Accelerating Broadband Development by Empowering Local <br /> Communities Act of 2019. <br /> RECOMMENDATION <br /> It is recommended that the City Council take a position supporting H.R. 530 — <br /> Accelerating Broadband Development by Empowering Local Communities Act of 2019. <br />
