Attachment 3 RESOLUTION NO. RESOLUTION ADOPTING A COUNCIL POLICY REGULATING SMALL WIRELESS FACILITIES PURSUANT TO PLEASANTON MUNICIPAL CODE CHAPTER 18.110 WHEREAS, Pleasanton Municipal Code section 18.110.010.6 authorizes the City to adopt a policy that establishes the rules and procedures by which the City reviews permit applications for small wireless facilities; and WHEREAS, the City has developed such a regulatory policy for small wireless facilities, which is attached to this resolution as Exhibit A, and incorporated herein by this reference (the "Policy"); and WHEREAS, subject to certain limitations in federal and California law, the City Council finds that the Policy is consistent with the provisions and intent in the General Plan, Pleasanton Municipal Code chapter 18.110, and other applicable provisions; and WHEREAS, the City Council finds that the Policy will, to the extent permitted by federal and California law, protect and promote public health, safety and welfare, and also balance the benefits that flow from robust, advanced wireless services with the City's local values, which include without limitation the aesthetic character of the City, its neighborhoods, and community. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Pleasanton as follows: 1. The above recitals are true and correct and incorporated herein by reference. 2. City Council Policy regulating small wireless facilities, attached to this resolution as Exhibit A, is hereby adopted. 3. Such policy shall be effective immediately and may be amended from time to time, or repealed, by resolution of the City Council.
