approval by the Director of Community Development prior to issuance of a building <br /> permit for tenant improvements and prior to operation of the childcare/preschool. <br /> In addition, as part of the plans submitted for issuance of building permit, Chabad of the <br /> Tri-Valley shall submit a plan showing the design, dimensions, number and locations of <br /> the play structures and surface materials of the play area for review and approval by the <br /> Director of Community Development. <br /> 8. The outdoor playground shall only be used by the childcare/preschool. The playground <br /> shall not be used when childcare/preschool is not open for business.The outdoor <br /> playground shall be occupied by a maximum of 24 children at any one time and for a <br /> maximum of 2.5 hours per day Monday through Friday during normal operating hours. <br /> 9. The proposed tubular steel fence around the outdoor playground shall be changed to a <br /> six-foot tall solid wood fence, matching the fence proposed for the outdoor terrace area. <br /> This revision shall be reflected on the plans submitted for the issuance of a building <br /> permit, and is subject to review and approval by the Director of Community <br /> Development prior to commencement of operation of the childcare/preschool. <br /> 10. Amplified sound (including but not limited to music and voice) taking place in the <br /> outdoor terrace area is allowed twice a year for any two of the 15 outdoor <br /> activiities/events and shall begin no earlier than 10 a.m. and end no later than 8 p.m. If <br /> amplification is used, speakers shall be directed away from adjoining residential uses <br /> immediately to the north. <br /> 11. All exterior doors and windows on the north side of the existing buildng remain closed <br /> during the operating hours. <br /> 12. The kitchen on the premises may only be used for the Chabad's functions, as stated in <br /> the narrative dated "Received January 8, 2018," on file with the Planning Division. The <br /> kitchen at the existing building shall not be rented for use by another user such as a <br /> catering company. <br /> 13. Chabad of the Tri-Valley shall submit a full-sized scalable floor plan, prepared by a <br /> licensed professional, to the Building and Safety Division as part of the building permit <br /> plan check review and permitting process. Said plan shall provide all information <br /> determined necessary by the Building and Safety Division for review of the building <br /> permit including, but not limited to the use of each room, dimensions of rooms and <br /> hallways, proposed partition details, window sizes and types, etc. Said plans shall be <br /> subject to review and approval by the Director of Community Development and Chief <br /> Building Official prior to issuance of a building permit. <br /> Case No. P16-0288 and P16-1883 City Council <br /> Page - 2 - <br />
