B. Employees subpoenaed or called to appear as a witness on behalf of the City or Department during <br /> their off duty hours shall receive compensation as hours worked in accordance with Section 7 of <br /> this MOU for all time necessarily spent in compliance of the subpoena or request to testify, <br /> including travel time, waiting time and time spent testifying as a witness. <br /> 15.4 Military Leave <br /> Military leave shall be granted in accordance with the provisions of law. All employees entitled to military <br /> leave shall give the Fire Chief an opportunity within the limits of military regulations to determine when <br /> such leave shall be taken and may modify the employee's work schedule to accommodate the request for <br /> leave. <br /> 15.5 Family, Medical and Pregnancy Disability Leave <br /> The City will abide by all federal and state family, medical and pregnancy disability leave laws. <br /> 15.6 Catastrophic Leave <br /> The City will maintain a Catastrophic Leave Policy as outlined in Appendix B to this MOU. <br /> 15.7 Bereavement Leave <br /> Employees are entitled to paid leave from duty (including shift trade days) for up to two (2) shifts (48 <br /> hours) for fire suppression personnel and up to forty (40) hours for fire prevention/40-hour personnel in <br /> order to attend the funeral or memorial service of an immediate family member and/or to assist with <br /> matters relating to the decedent's estate. Employees may utilize other paid leaves (including sick leave) <br /> to extend bereavement leave when approved by the Fire Chief. <br /> For purposed of this provision, immediate family shall be defined as: spouse, domestic partner, child, <br /> foster child who resided with the employee at the time of his/her death, stepchild, mother, father, <br /> stepmother, stepfather, mother-in-law, father-in-law, brother, stepbrother, sister, stepsister, brother-in- <br /> law, sister-in-law, grandmother, grandfather, spouse's grandmother, spouse's grandfather, son-in-law, <br /> daughter-in-law or grandchildren. <br /> 15.8.1 Union Leave Bank <br /> A. Leave Donations <br /> Effective the first full pay period in July of each year, active bargaining unit employee may <br /> voluntarily elect to contribute to the Union Leave Bank by reducing their individual vacation <br /> accrual by six (6) hours for 56 hour personnel and either four (4) hours of vacation accrual or <br /> compensatory time for 40 hour personnel. The contribution will be credited to the Union Leave <br /> Bank. If, at the end of any fiscal year, the Union Leave Bank has a balance of more than 1500 <br /> hours, the contribution of hours described above will not occur for that fiscal year. <br /> 21 <br />
