BACKGROUND AND DISCUSSION <br /> In July/August of 2018, PUSD approached the City with a proposal to install new <br /> fencing at the perimeter of two of its school sites, Mohr Elementary, which adjoins the <br /> City-owned Amaral Park; and Fairlands Elementary, which adjoins Fairlands Park. Due <br /> to the adjacent parks and shared property lines, PUSD requested input from the City on <br /> the proposal, and has proposed that an MOU and License Agreement be prepared for <br /> each site that clearly establishes the roles and responsibilities of PUSD and the City <br /> with respect to installation and maintenance of the fence. <br /> The Draft MOU/License Agreements are included in Attachment 1. The proposed <br /> fencing plans are included as an Exhibit B of the respective agreements and in <br /> Attachment 2 of this Agenda Report. As shown, six-foot tall chain-link fences would be <br /> installed by PUSD around the school site perimeter, in most places following the <br /> property line. Metal picket fences would be installed in some areas. Gates/entry points <br /> would be included at locations along the fence line, to allow for continued <br /> pedestrian/bike access from the adjacent parks for students. The Mohr School fence <br /> would generally follow the line of existing fencing; the Fairlands School fence would be <br /> adjusted outward from its current location along the north side of the campus. <br /> Key terms of the MOU include: <br /> • PUSD responsibility for all costs to design, install and maintain the fences. <br /> • District to provide courtesy review of fence design, location, and construction <br /> specifications to the City, and any of any subsequent changes to the plans. <br /> • Notification to the City prior to start of any construction, maintenance or <br /> replacement of fences. <br /> • Indemnification from any claims associated with PUSD's use of City property for <br /> fence installation and maintenance. <br /> The License Agreement for each site would require PUSD to maintain the fences and to <br /> accommodate any future use of the license area by the City or another public utility. <br /> The agreement may be terminated by either party, subject to 120 days notice. <br /> Subfnittd Fisc eview: Approve by: <br /> .rcotA Gerry Beaudi Tina Olson Nelson Fialho <br /> Director of Community Director of Finance City Manager <br /> Development <br /> Attachments: <br /> 1.
