RESOLUTION NO. 18-1042 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON DEDICATING A PUBLIC UTILITY EASEMENT TO THE PUBLIC UTILITIES ON THE KOTTINGER GARDENS PROPERTY LOCATED AT 251 KOTTINGER DRIVE WHEREAS, on June 3, 2014, the City Council approved PUD-101 (Kottinger Gardens) a Planned Unit Development application by MidPen Housing Corporation (MidPen)to construct 185 senior homes and related site improvements located at 240 and 251 Kottinger Drive; and WHEREAS, the City of Pleasanton is the property owner of 240 and 251 Kottinger Drive; and WHEREAS, Kottinger Gardens will be constructed in two phases: Phase 1 will replace the existing 50 senior homes of Kottinger Place, 240 Kottinger Drive, with 131 senior homes and Phase 2 will replace the existing 40 senior homes of Pleasanton Gardens, 251 Kottinger Drive, with 54 senior homes; and WHEREAS, the construction of Phase 1 is complete and the City Council accepted the public improvements associated with Phase 1 on May 15, 2018; and WHEREAS, Phase 2, includes the demolition of all existing buildings and almost all of the wet and dry utilities at Kottinger Place, 251 Kottinger Drive; and WHEREAS,the City Council finds that a public utility easement of varying width dedicated to the Public Utilities provides for the access needed for the Public Utilities to install, operate, maintain and repair their new on-site facilities to serve the new buildings as part of Phase 2; NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER THE FOLLOWING: SECTION 1. The City Council finds that the Public Utilities need access to install, operate, maintain, and repair their new on-site facilities to serve the new buildings as part of Kottinger Gardens, Phase 2, located at 251 Kottinger Drive. SECTION 2. The City will dedicate a public utility easement of varying width to the Public Utilities on the Kottinger Gardens property located at 251 Kottinger Drive. SECTION 3. The City Manager is authorized to execute the declaration of public utility easement and the City Clerk is directed to cause such document to be recorded in the County of Alameda Clerk-Recorder's Office. PASSED, APPROVED, AND ADOPTED by the City Council of the City of Pleasanton at a regular meeting held on September 4, 2018.
