RESOLUTION NO. 18-1042 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> DEDICATING A PUBLIC UTILITY EASEMENT TO THE PUBLIC UTILITIES ON THE <br /> KOTTINGER GARDENS PROPERTY LOCATED AT 251 KOTTINGER DRIVE <br /> WHEREAS, on June 3, 2014, the City Council approved PUD-101 (Kottinger Gardens) a <br /> Planned Unit Development application by MidPen Housing Corporation (MidPen)to construct 185 <br /> senior homes and related site improvements located at 240 and 251 Kottinger Drive; and <br /> WHEREAS, the City of Pleasanton is the property owner of 240 and 251 Kottinger Drive; <br /> and <br /> WHEREAS, Kottinger Gardens will be constructed in two phases: Phase 1 will replace the <br /> existing 50 senior homes of Kottinger Place, 240 Kottinger Drive, with 131 senior homes and <br /> Phase 2 will replace the existing 40 senior homes of Pleasanton Gardens, 251 Kottinger Drive, <br /> with 54 senior homes; and <br /> WHEREAS, the construction of Phase 1 is complete and the City Council accepted the <br /> public improvements associated with Phase 1 on May 15, 2018; and <br /> WHEREAS, Phase 2, includes the demolition of all existing buildings and almost all of the <br /> wet and dry utilities at Kottinger Place, 251 Kottinger Drive; and <br /> WHEREAS,the City Council finds that a public utility easement of varying width dedicated <br /> to the Public Utilities provides for the access needed for the Public Utilities to install, operate, <br /> maintain and repair their new on-site facilities to serve the new buildings as part of Phase 2; <br /> NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER THE FOLLOWING: <br /> SECTION 1. The City Council finds that the Public Utilities need access to install, operate, <br /> maintain, and repair their new on-site facilities to serve the new buildings as part of Kottinger <br /> Gardens, Phase 2, located at 251 Kottinger Drive. <br /> SECTION 2. The City will dedicate a public utility easement of varying width to the Public <br /> Utilities on the Kottinger Gardens property located at 251 Kottinger Drive. <br /> SECTION 3. The City Manager is authorized to execute the declaration of public utility <br /> easement and the City Clerk is directed to cause such document to be recorded in the County of <br /> Alameda Clerk-Recorder's Office. <br /> PASSED, APPROVED, AND ADOPTED by the City Council of the City of Pleasanton at <br /> a regular meeting held on September 4, 2018. <br /> I, Karen Diaz, City Clerk of the City of Pleasanton, certify that the foregoing resolution was <br /> adopted by the City Council at a regular meeting held on the 4th day of September, 2018, by the <br /> following vote: <br /> Ayes: Councilmembers Brown, Narum, Olson, Pentin, Mayor Thorne <br /> Noes: None <br /> Absent: None <br /> Abstain: None <br />
