CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 739 <br /> <br /> AN ORDINANCE AMENDING ARTICLE 8 (LITTER), CHAPTER 2 <br /> (SPECIAL PERMITS), TITLE IV (HEALTH, SAFETY, MORAL <br /> AND GENERAL WELFARE) OF THE ORDINANCE CODE OF THE <br /> CITY OF PLEASANTON, RELATING TO THE DISTRIBUTION <br /> OF NEWSPAPERS AND HANDBILLS UPON PRIVATE PREMISES. <br /> <br /> THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY <br />ORDAIN AS FOLLOWS: <br /> <br /> Section 1. Article 8, Chapter 2, Title IV of the Ordinance <br />Code of the City of Pleasanton is hereby amended by the addition <br />of a section to read as follows: <br /> <br /> Section 4-3 50 Distribution of Newspapers and Handbills · . <br /> Upon P'~ate Prem'~S~. '~ <br /> <br /> a. In addition to the prevention of litter which is <br /> the purpose of all the provisions of this article, <br /> this section has the following two purposes: <br /> <br /> (1) to protect the privacy of citizens from the <br /> delivery of newspapers ~ commercial handbills, <br /> and non-commercial handbills to which the <br /> citizens have objected in the manner pre <br /> scribed in subsection (b); and <br /> <br /> (2) to protect citizens during extended absence <br /> from their residences against the visible <br /> accumulation of newspapers, commercial hand- <br /> bills, and non-commercial handbills that the <br /> citizens do not express or have not expressed <br /> a willingness to receive, and thus to lessen <br /> the risk that residences will be burglarized <br /> or vandalized during absence of the occupants. <br /> <br /> b. No person shall distribute~ circulate, deliver, <br /> or deposit any newspaper ~ commercial handbill ~. or <br /> nonl-commercial handbill upon any private premises <br /> if the owner or occupant thereof not more than <br /> one year previously has notified the distributor <br /> of such newspaper, commercial handbill, or non-. <br /> commercial handbill not to deliver it to the pre <br /> mises of the objecting owner or occupant. Such <br /> notification shall be sent by registered or cer- <br /> tified mail, postage prepaid, return receipt re- <br /> quested, and shall include the name of the objec~!~ <br /> ting owner or occupants the address where no dis <br /> tribution is to be made, the declarant's capacity <br /> to make such objection, and the name of the news~ <br /> <br /> <br />
