<br /> AN ORDINANCE AMENDING ARTICLE 1, (SOLICITORS AND
<br /> CERTAIN BUSINESSES), CHAPTER 2 (SPECIAL PERMITS),
<br /> TITLE IV (HEALTH, SAFETY, MORAL AND GENERAL WEL-
<br /> FARE) OF THE ORDINANCE CODE OF THE CITY OF PLEAS-
<br /> ANTON RELATING TO DEFINITIONS OF PEDDLER, SOLICITOR,
<br /> AND TRANSIENT MERCHANT.

<br /> THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY
<br />ORDAIN AS FOLLOWS:
<br />
<br /> Section 1. Section 4-1.35 (Definitions) is added to
<br />
<br />Title IV of the Ordinance Code of the City of Pleasanton to
<br />read as follows:
<br />
<br /> Section 4-1.35 Definitions. As used in this article,
<br /> the words and phrases contained herein shall have the
<br /> following definitions:
<br />
<br /> (a) "Peddlers" shall include any person whether
<br /> a resident of the City or not, traveling by
<br /> foot, wagon, automotive vehicle, or any other
<br /> type of conveyance from place to place, from
<br /> house to house, or from street to street,
<br /> carrying, conveying or transporting goods, wares,
<br /> merchandise, food products, meats, fish, vege-
<br /> tables, fruits, garden truck, farm products, or
<br /> provisions, offering and exposing the same for
<br /> sale or making sales and delivering articles
<br /> to purchasers, or who, without traveling from
<br /> place to place, shall sell or offer the same
<br /> for sale from a wagon, automotive vehicle,
<br /> railroad car, or other vehicle or conveyance.
<br /> Any person who solicits orders and as a separate
<br /> transaction makes deliveries to purchasers as
<br /> a part of a scheme or design to evade the pro-
<br /> visions of this chapter shall be deemed a peddler
<br /> subject to the provisions of this chapter. The
<br /> word "peddler" shall include the words "hawker"
<br /> and "huckster."
<br />
<br /> (b) "Solicitor" is defined as any individual, whether
<br /> a resident of the City or not, traveling either
<br /> by foot, wagon, automobile motor truck, or any
<br /> other type of conveyance from place to place,
<br /> from house to house, or from street to street,
<br /> taking, or attempting to take, orders for the
<br /> sale of goods, wares and merchandise, personal
<br /> property of any nature whatsoever for future
<br /> delivery, or for services to be furnished or
