ORDINANCE NO. 2185 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON AMENDING <br /> MUNICIPAL CODE CHAPTER 3.32 ALTERNATE BIDDING PROCEDURES UNDER THE <br /> UNIFORM PUBLIC CONSTRUCTION COST ACCOUNTING ACT, TO INCREASE THE <br /> DOLLAR AMOUNTS FOR LETTING CONTRACTS BY FORMAL OR INFORMAL <br /> PROCEDURES <br /> WHEREAS, on August 20, 2018, Governor Brown signed Assembly Bill 2249 to increase the <br /> bid limits for the Uniform Public Construction Cost Accounting Act, with the new limits going into effect <br /> on January 1, 2019; and <br /> WHEREAS, the City of Pleasanton has a history of following state law with regard to public <br /> bidding requirements and the Pleasanton Municipal Code (PMC) mirrors state law with regard to public <br /> contracting procedures in PMC section 3.32; and <br /> WHEREAS, an agency must affirmatively adopt the changes in state law in order to take <br /> advantage of the new bid limits. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY <br /> ORDAIN AS FOLLOWS: <br /> SECTION 1. Amends the Municipal Code by making the following changes to Section <br /> 3.32.010, Contracting Procedures for Public Projects: <br /> A. Public projects of $60,000 or less may be performed by the employees of the city by <br /> force account, by negotiated contract or by purchase order. <br /> B. Public projects of $200,000 or less may be let to contract by informal procedures as set <br /> forth in Section 22032 et seq., of the Public Contract Code. <br /> C. Public projects of more than $200,000 shall, except as otherwise set forth in Section <br /> 22032 et seq., of the Public Contract Code. be let to contract by formal bidding procedure. <br /> SECTION 2. A summary of this ordinance shall be published once within fifteen (15) days after <br /> its adoption in "The Valley Times", a newspaper of general circulation published in the City of <br /> Pleasanton, and the complete ordinance shall be posted for fifteen (15) days in the City Clerk's office <br /> within fifteen (15) days after its adoption. <br /> SECTION 3. This ordinance shall be effective on January 1, 2019, consistent with the effective <br /> date of AB 2249. <br /> The foregoing Ordinance was introduced at a regular meeting of the City Council of the City of <br /> Pleasanton on October 16, 2018 by the following vote: <br /> Ayes: Councilmembers Brown, Narum, Olson, Pentin, Mayor Thorne <br /> Noes: None <br /> Absent: None <br /> Abstain: None <br />
