A condition has been added to the <br /> Preannexation Agreement to address the situation if LAVWMA approval is required. <br /> Staff recommends the City Council support the water and sanitary sewer connections <br /> requested by the property owner with an agreement to annex into the city at a future <br /> date as part of annexation of a larger area. The extension of City services shall be <br /> subject to LAFCo approval (and, if needed, LAVWMA approval), and if the <br /> preannexation agreement is approved, the property owner will make those applications. <br /> While past practice has had the City apply to LAFCo on behalf of the property owner, <br /> the LAFCo Executive Director has recently confirmed with City staff that the proper <br /> party to make application to LAFCo shall be the property owner in circumstances that <br /> involve failed water wells and/or septic systems. All requests for out-of-area service <br /> agreement shall be accompanied with a City pre-annexation agreement approved by <br /> the City.
