City Manager Fialho stated he cannot say that he does, at this time. He added he has the <br /> responsibility of enforcing Conditions of Approval, and revisions were received at 4:30 p.m. this <br /> afternoon. Inconsistencies have been brought up during public comments. Staff needs time to <br /> review the documentation, meet with both appellants, and return to the City Council with <br /> meaningful recommendations. He requested that this public hearing be continued. <br /> Mayor Thorne announced the public hearing will be continued but not to a specific date and will <br /> be re-noticed/advertised. <br /> Councilmember Narum would like to ensure the playground is not used during weekends as listed <br /> in the Conditions of Approval; she would like to know the maximum capacity of the patio and the <br /> inside meeting area. <br /> Councilmember Brown noted public comments are a matter of record and will be in the meeting <br /> minutes. <br /> Mayor Thorne reiterated his appreciation for the effort of the appellants to reach a compromise. <br /> Councilmember Olson added that for Council to decide, it needs to have a clean set of Conditions <br /> of Approval. <br /> This public hearing was continued to a future date to be determined and will be re-advertised and <br /> re-noticed. <br /> RECESS/RECONVENE <br /> Council took a recess at 8:51 p.m. The meeting reconvened at 9:00 p.m. with all Councilmembers <br /> present except Councilmember Pentin. <br /> 21. Public Hearing: Consider actions related to Urgency (Interim) Ordinance No. 2182 prohibiting the <br /> issuance of specified approvals and permits for new or expanding massage establishments within <br /> the Downtown Specific Plan area: (1) issuance of a written report describing measures taken to <br /> alleviate the condition which led to the adoption of the ordinance; and (2) extending the Ordinance <br /> for 22 months and 15 days <br /> Planning Manager Ellen Clark presented the report and displayed a PowerPoint presentation <br /> addressing a summary of the matter, the definition of an urgency ordinance, existing regulations, <br /> existing downtown massage establishments, the Downtown Specific Plan update, public <br /> comments received after July 17, 2018 meeting, and recommendation and options. <br /> Mayor Thorne noted prohibitions are in the Downtown Specific Plan area; no where else in the <br /> City. <br /> Councilmember Brown referenced items not prohibited including expansion to four or more <br /> technicians for existing establishments and asked for clarification. Planning Manager Clark <br /> reported an establishment could hire four or more technicians, up to the number allowed in the <br /> CUP. It was noted the zoning certificate is a permitted use for three or fewer technicians operating <br /> in one location, but there is a CUP requirement in terms of four or more technicians and the intent <br /> is to allow new technician permits to be issued during the moratorium to allow existing businesses <br /> to continue to function.
