ATTACHMENT 1 <br /> THIRD AMENDMENT TO AGREEMENT <br /> This third Amendment to Agreement ("Third Amendment") is entered into this 4th day of September <br /> 2018 by the City of Pleasanton("City") and Economic & Planning Systems, Inc. (EPS) ("Consultant"). <br /> Whereas, on October 20, 2015 the City and Consultant entered into a Professional Services <br /> Agreement for development impact fee analysis, recommendations, presentations and report services <br /> ("Agreement"); and <br /> Whereas,on March 9, 2017 the City and Consultant entered into a first amendment to the <br /> contract to extend the expiration date to October 27, 2017; and <br /> Whereas,on May 1, 2018 the City and Consultant entered into a second amendment to increase <br /> compensation for services by$10,000 and to extend the expiration date to October 19, 2018; and <br /> Whereas,the total compensation for services in the original contract was not to exceed <br /> $145,070; and <br /> Whereas,the parties desire to amend to the Agreement; <br /> Now,therefore, in exchange for valuable consideration, the receipt of which is hereby acknowledged, <br /> the parties agree as follows: <br /> 1. Section 4. Compensation, is amended to read: <br /> "Total Compensation for services and reimbursement for costs shall not exceed <br /> $160,070." <br /> 2.
