Pleasanton Development Impact Fee Nexus Study <br /> Draft Report 07/12/18 <br /> • Fee Amount Must Be Based on a Rational Nexus. An impact fee amount must be based <br /> on a reasonable nexus, or connection, between new development and the needs and <br /> corresponding costs of the capital facilities and improvements need to accommodate it. As <br /> such, an impact fee must be supported by specific findings that explain or demonstrate this <br /> nexus or relationship. In addition, the impact fee amount must be structured such that the <br /> revenue generated does not exceed the cost of providing the facility or improvement for <br /> which the fee is imposed. <br /> Summary of Maximum Proposed Fee Schedule <br /> Table 1 summarizes the City's maximum allowable development impact fee schedule for the <br /> capital facility and equipment needs evaluated in this Nexus Report. The maximum fee <br /> estimates include a 3 percent fee program administration fee, consistent with other Mitigation <br /> Fee Act program administrative costs in many other California jurisdictions.' Fees apply to all <br /> new development inside the City limits, unless otherwise exempted by Ordinance. When <br /> adopted, the new fees will replace the City's existing fee schedule charged to new development <br /> (exclusive of existing development agreements), for parks and recreational facilities, public <br /> facility improvements, and transportation, and will add a new fee for downtown beautification. <br /> 1 The 3 percent administration cost is designed to cover expenses for preparation of the development <br /> impact fee and subsequent updates as well as the required reporting, auditing, collection and other <br /> annual administrative costs involved in overseeing the program.
