BACKGROUND <br /> The project site at 3370 Hopyard Road was occupied by the Pleasanton Masonic <br /> Center from 1980, when the building was constructed, until 2017. The Pleasanton <br /> Masonic Center was a private lodge and its operation at the site was authorized by the <br /> City based on a Conditional Use Permit (CUP) (Case No. UP-77-13). In June 2016, to <br /> address issues associated with special events and activities conducted outside of those <br /> permitted by the 1977 CUP, the Masons applied to modify the CUP. The Planning <br /> Commission approved the changes; however; the approval was appealed to the City <br /> Council. In September 2016, the City Council heard the appeal, and ultimately denied <br /> the appeal, approving the project, but with further modifications to the conditions to <br /> include additional limitations on permitted activities and the locations of those activities, <br /> and to require physical modifications to the building to address noise and other issues. <br /> Council's approval of the project is attached as Attachment 9. <br /> In February 2016 and December 2016, Rabbi Raleigh Resnick filed applications for a <br /> CUP and Design Review (DR), respectively, to operate a religious institution with a <br /> childcare/preschool, and for site modifications including the installation of a playground <br /> and a terrace for outdoor activities. <br /> Around September 2017, Chabad formally acquired the site from the Masons. The City <br /> determined that Chabad could continue to operate as an assembly use under the 2016 <br /> CUP, but any change in use, such as operating a preschool or addition of outdoor uses, <br /> would require a new or modified CUP. <br /> April 25, 2018 Planning Commission Hearing <br /> The Planning Commission considered the subject applications. Testimony, both for and <br /> against the project, was provided by numerous members of the public in attendance. <br /> Concerns expressed by the nearby residents were principally focused on potential noise <br /> and nuisance associated with outdoor activities including the number, size, and <br /> frequency of outdoor activities/events and use of the outdoor play area for the <br /> preschool. The applicant's representatives, while urging the Planning Commission to <br /> approve the project, submitted a letter from their legal counsel and verbally reiterated <br /> some requested modifications to several of the conditions that had been included in the <br /> approval recommended by staff. The requested modifications were focused on use of <br /> the outdoor areas, playground location and usage, and parking lot monitoring <br /> requirements. <br /> The Commission acknowledged the previous use and history of activities that had <br /> occurred on the project site as the basis of neighbors' concerns, and noted that there <br /> appears to have been limited consultation between Chabad and the <br /> neighbors/neighborhood to try and find solutions and agreement on how the site would <br /> be used going forward. There was consensus among the Commissioners that additional <br /> effort should be made by Chabad to try to find some agreement before the Planning <br /> Commission took action on the application. The matter was continued, without a new <br /> hearing date set at that time. <br /> Page 2 of 15 <br />
