ATTACHMENT 1 <br /> RESOLUTION NO. <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> APPROVING A PREANNEXATION AND SANITARY SEWER FACILITIES AND <br /> SERVICES AGREEMENT WITH ARTHUR BALIZAN FOR THE PROPERTY <br /> LOCATED AT 6409 ALISAL STREET AND AUTHORIZING AN APPLICATION <br /> TO THE LOCAL AGENCY FORMATION COMMISSION FOR OUT-OF-AREA <br /> SERVICE <br /> WHEREAS, at the meeting of July 17, 2018, the City Council received a report <br /> from the Director of Community Development regarding the request from Arthur Balizan <br /> for sanitary sewer connection to existing residence located at 6409 Alisal Street, in <br /> unincorporated Alameda County; and <br /> WHEREAS, Government Code Section 56133 requires a city that wishes to <br /> provide utility services beyond its jurisdictional boundary to obtain approval from the Local <br /> Agency Formation Commission (LAFCo); and <br /> WHEREAS, the City Council adopted Resolution No.17-961 allowing owners of <br /> property within the unincorporated Happy Valley area to apply for City water and/or City <br /> sanitary sewer services, which applications will be considered on a case-by-case basis <br /> using specified criteria; and <br /> WHEREAS, the request meets the criteria for out-of-area service prior to <br /> annexation due to the property being located within the City's sphere of influence and the <br /> owner consents to enter into an agreement which meet the City's interests. <br /> NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE <br /> CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER <br /> THE FOLLOWING: <br /> SECTION 1. This request is categorically exempt from review under the California <br /> Environmental Quality Act pursuant to Title 14 California Code of Regulations §15303(d) <br /> for new sewage extension. <br /> SECTION 2. Approves and authorizes the City Manager to execute a <br /> Preannexation and Sanitary Sewer Facilities and Services Agreement with Arthur Balizan <br /> for the property located at 6409 Alisal Street, attached as Exhibit A, subject to LAFCo <br /> approval. <br /> SECTION 3. Authorizes staff to file applications with LAFCo for its consideration <br /> of an out-of-area service agreement and with LAW/MA for service outside of jurisdictional <br /> limits, for the City to provide sanitary sewer service to the existing residence located at <br /> 6409 Alisal Street after receipt of the requisite filing fees. <br /> Page 1 of 7 <br />
