Accept the list of general priority areas for future acquisition in anticipation of the <br /> preparation of a more refined list in accordance with the Altamont Landfill Settlement <br /> Agreement. <br /> 2. Determine the expenditure of up to $23,650 of Altamont Open Space Funds for <br /> services to be performed by the University of California, Berkeley related to <br /> identifying, ranking, and mapping high conservation values in Eastern Alameda <br /> County as part of strategic planning to guide decision-making for future open space <br /> acquisitions is consistent with the Altamont Landfill Settlement Agreement. <br /> FINANCIAL STATEMENT <br /> There is no cost to the City of Pleasanton associated with this Resolution. Expenditures <br /> are to be paid with Altamont Open Space Funds. <br /> BACKGROUND <br /> As part of the settlement of litigation over the expansion of the Altamont Landfill, the <br /> parties to the litigation agreement (Alameda County, Waste Management of Alameda <br /> County, the Cities of Livermore and Pleasanton, and various environmental groups) <br /> agreed that the County would impose a fee totaling $0.75 per ton at the Altamont <br /> Landfill and Resource Recovery Facility for open space acquisition. Eighty percent of <br /> the Open Space Fee is designated for open space expenditures in the eastern portion <br /> of the East County and 20 percent is for expenditures in the western portion of East <br /> County (see Attachment 2). As of March 1, 2018, the total amount available in the open <br /> space fund for the eastern area was $13,739,678, and the total amount available for the <br /> western area was $828,874. <br /> The Open Space Committee consists of one member appointed by the Board of <br /> Supervisors, one member appointed by the Livermore City Council, one member <br /> appointed by the Pleasanton City Council, and one member appointed by the Sierra <br /> Club. Subsection 7.4.2 of the Altamont Settlement Agreement requires that the <br /> Committee prepare two priority lists of properties for acquisition in fee or permanent <br /> easement, one for each of the geographic areas of concern as defined in Subsection <br /> 7.3.1. The Committee is also required to prepare proposed allocations of funds in the <br /> Open Space Account for expenditure during the upcoming year from each of the <br /> proposed priority lists. <br /> Subsection 7.4.7 of the Settlement Agreement states that by approval of a majority of <br /> the members of the Advisory Committee, and concurrence by the County and cities, up <br /> to 5 percent of the funds received in any given year may be expended for the services <br /> of independent consultants to aid the Advisory Committee in carrying out its duties to <br /> identify open space areas in need of protection and to make plans for their acquisition. <br /> DISCUSSION <br /> At the Open Space Committee's September 16, 2016 meeting, the Committee adopted <br /> a list of general priority areas as an initial step in the process of developing more <br /> specific lists of properties for acquisition, including fund allocations, pursuant to <br /> Page 2 of 4 <br />
