The City may extend the time for completion of improvements hereunder, upon good cause <br /> being shown by the Subdivider. Any such extension may be granted without notice to the <br /> Subdivider's surety; any extension so granted shall not relieve the surety's liability on the bond to <br /> secure the faithful performance of this Agreement. <br /> 2. Work. Subdivider will do or cause to be done and performed the following described work: <br /> Improvements pursuant to plans and project bond estimates entitled: <br /> A. Irby Ranch Improvement Plans—Wet Utilities for Tract 8245,prepared by Carlson, <br /> Barbee&Gibson, Inc.,dated May 2018; Engineer's Preliminary Bond Estimate, dated <br /> April 16,2018; and subsequent revisions to the plans as prepared by Carlson, Barbee& <br /> Gibson, Inc. and approved by the City Engineer. <br /> B. Irby Ranch Improvement Plans for Tract 8245,prepared by Carlson, Barbee &Gibson, <br /> Inc., dated June 2018;Engineer's Preliminary Bond Estimate, dated April 16, 2018; and <br /> subsequent revisions to the plans as prepared by Carlson, Barbee&Gibson, Inc. and <br /> approved by the City Engineer. <br /> B. Landscape Construction Documents for The Homestead at Irby Ranch,prepared by vTA <br /> Landscape Architects, dated May 4,2018; and subsequent revisions to the plans as <br /> prepared by vTA Landscape Architects and approved by the City Engineer. <br /> C. Joint Trench Composite Plans,prepared by Giacalone Design Services, Inc. dated May 2, <br /> 2018, 2018,and subsequent revisions to the plans as prepared by Giacalone Design <br /> Services, Inc and approved by the City Engineer. <br /> 3. Acquisition of Right-of-Way. A portion of the improvements are to be constructed on <br /> property neither owned by Subdivider or City comprised of portions of Parcel 3 of Parcel Map <br /> 2298 (APN 946-1680-13-4,the "Public Storage Parcel") and Parcel E of Tract 4401 (APN 946- <br /> 4542-11,the"Auf der Maur Parcel")needed for roadway purposes collectively referred to as <br /> "Offsite Property". City anticipates receiving and recording irrevocable offers of dedication for <br /> the Offsite Property,which the City will accept at the time the improvements are complete and <br /> are accepted by the City. However,to the extent the City does not receive such irrevocable <br /> offers of dedication, Subdivider is ultimately responsible for acquiring the offsite property and <br /> dedicating it to the City. Subdivider is also responsible for securing any needed construction <br /> easements it may need to complete the work. <br /> A. Subdivider shall make every reasonable effort to acquire the Offsite Property by <br /> negotiated purchase as needed for dedication to the City. <br /> B. If Subdivider is unable to acquire the Offsite Property by negotiated purchase, <br /> Subdivider may request the City to initiate and pursue acquisition of such Offsite Property. <br /> To the extent that the City is unable to acquire any of the Offsite Property through a voluntary <br /> acquisition,the City agrees to make a good faith effort to schedule a hearing for the purpose of <br /> considering a resolution of necessity authorizing the use of the City's eminent domain authority, <br /> Subdivision Agreement <br /> Tract 8245—Meritage of California,Inc.
