the sanitary sewer main, storm drain system, water main, fire hydrants, and street lights located within this street. • Traffic signal and associated improvements at the intersection of First Street/Stanley Boulevard and Nevada Street. • The sanitary sewer mains, water mains, and fire hydrants within the following private streets: o Bottarini Court, Brumm Court, Cavestri Circle, Huested Street, Irby Court, Irby Ranch Road, Jeremiah Way, McKinney Lane, Robby Court, and Sunflower Hill Way • The public sanitary sewer main within the existing and proposed Nevada Street that will connect the existing sanitary sewer main on First Street/Stanley Boulevard to the existing sanitary sewer main on existing Bernal Avenue. • The public water main within the existing and proposed Nevada Street that will connect the existing water main on First Street/Stanley Boulevard to the existing water main on existing Nevada Street. • The public trail east of Tract 8245 and on the south side of existing and proposed Nevada Street. Private Improvements The private improvements that will be maintained by the Tract 8245 homeowners association include: • New private streets (Bottarini Court, Brumm Court, Cavestri Circle, Huested Street, Irby Court, Irby Ranch Road, Jeremiah Way, McKinney Lane, Robby Court, and Sunflower Hill Way) • A park (Kaplan Park) on Parcel G • A park (Central Park) on Parcel D • Open spaces on Parcels A, E, F, H, I, J and K • The Zia House located on Parcel K • Bio-swales for stormwater treatment • Private utilities (including street lights and storm drain systems within the private streets) Discretion to Deny the Final Map The approval of the Final Map, when the Final Map substantially complies with the conditions of the Vesting Tentative Map, is a mandatory, ministerial act (Government Code, Section 66474.1). A Final Map shall be disapproved only for failure to meet conditions that were applicable at the time the Vesting Tentative Map was approved. If the Final Map is disapproved, there must be a finding identifying the conditions which were not met (Government Code, Section 66473). Page 3 of 4
