BACKGROUND <br /> On February 12, 2014, the Planning Commission recommended the approval of PUD- <br /> 84, a Planned Unit Development (PUD) application by Frank and Barbara Berlogar to <br /> construct two new single-family homes and related infrastructure on an approximately <br /> 37.4-acre site located at 88 Silver Oaks Court. <br /> On May 6, 2014, the City Council approved PUD-84 by adopting Ordinance No. 2096. <br /> On April 22, 2014, the Staff Review Board, acting under its authority, approved a minor <br /> subdivision application by Frank and Barbara Berlogar to subdivide the subject property <br /> into three lots: one lot for the existing home and one lot for each of the two new single- <br /> family homes. <br /> All subdivision improvements have been constructed and the public improvements are <br /> ready for acceptance. <br /> DISCUSSION <br /> Construction of Subdivision Improvements <br /> The subdivision agreement provided for the construction of improvements that <br /> consisted of a public sanitary sewer main and manhole to serve the two new single- <br /> family homes as required per Section 15.32.090 of the Municipal Code. Additionally, a <br /> private road, a private storm drain system, private sanitary sewer laterals, private water <br /> laterals and one fire hydrant, a bio-swale and related private improvements were <br /> constructed to serve the two new single-family homes. <br /> Public Subdivision Improvements <br /> The following improvements will be operated and maintained by the City: 8-inch sanitary <br /> sewer main and manhole located within the private road; and approximately 30 feet of <br /> curb and gutter and eight linear feet of an eight-inch water lateral located within Silver <br /> Oaks Court, a public street. <br /> Private Subdivision Improvements <br /> The private road, labeled as "Private Road" on the improvement plans, the two sanitary <br /> sewer laterals, the two water laterals, the storm drain system, the bio-swale located on <br /> Lot 1, the fire hydrant located on Lot 2, the security gate located on Lot 2, and the <br /> retaining walls will maintained by the owners of Lots 1 and 2 pursuant to the Declaration <br /> of Easements and Maintenance Agreement for Parcel Map 10248 that was recorded at <br /> the Alameda County Clerk-Recorder's Office. <br /> Page 2 of 3 <br />
