Exhibit B. Reimbursement from the Benefited Properties shall be based upon the costs in <br /> Exhibit B. <br /> Section 3. Ownership of Improvements. <br /> Developer has dedicated the Improvements and City has accepted the Improvements. <br /> Developer has the right to connect to and use the Improvements in accordance with City <br /> regulations and the right to reimbursement for the Reimbursable Costs for the Improvements, as <br /> provided herein. <br /> Section 4.Amount of Reimbursable Costs. <br /> The amount of pro rata Reimbursable Costs(plus interest per Section 7) due from each <br /> owner of the Benefited Properties("Property Owners")and the City is set forth on Exhibit A. <br /> The City shall use its best efforts to obtain the pro rata Reimbursable Costs from the other <br /> Property Owners. As of July 1, 2017,the City has collected $187,977.00 (present value <br /> including interest is $251,089.00)from previous developers towards the reimbursement for the <br /> Improvements. <br /> Section 5.Developer's Share. <br /> Developer's share of the costs of the Improvements($875,355.00)has been deemed contributed <br /> by reason of the completion of construction of the Improvements and the City's acceptance <br /> thereof. <br /> Section 6. Establishment of Fee. <br /> The City has previously collected and shall collect from the Property Owners reimbursement <br /> fees in the amounts specified in Exhibit A plus adjustments made each January 1st of each <br /> calendar year to reflect the addition of interest per Section 7("Reimbursement Fee or <br /> Reimbursement Fees"). <br /> Section 7. Interest. <br /> Simple interest at the Bank of America prime rate/reference rate: <br /> http://newsroom.bankofamerica.com/press-kit/prime-rate-information shall be added to the <br /> Reimbursement Fee described in Section 6 herein each calendar year on January 1st. <br /> Section 8. Time of Collection. <br /> The City shall require payment of the Reimbursement Fees as a condition of approval of a <br /> tentative map, final map, or the first issuance of any permit for development of property within <br /> the Benefit Area. The City shall collect the Reimbursement Fees at the time of approval of any <br /> final map or parcel map for buildable lots or upon the issuance of a building permit for any <br /> development of property within the Benefit Area. <br />
