ORDINANCE NO. 2177 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> AMENDING MUNICIPAL CODE CHAPTER 9.04 NOISE REGULATIONS TO <br /> DELETE SECTION 9.04.045 LEAF BLOWERS, THEREBY SUBJECTING LEAF <br /> BLOWERS TO GENERAL NOISE TIME RESTRICTIONS AND DECIBEL LIMITS <br /> WHEREAS, the City of Pleasanton supports the reduction of noise to acceptable levels <br /> throughout the community (see General Plan Noise Element - Goal 1); and <br /> WHEREAS, the current noise limit time restrictions for leaf blowers allow for earlier <br /> starting times (6 a.m.) than for general activities (8 a.m.), and this early start time has resulted <br /> in residents' complaints about mornings disrupted by leaf blowers; and <br /> WHEREAS, the specified leaf blower models listed in the code are out-of-date, and <br /> allowing leaf blowers to generate up to 73 decibels at 50 feet is no longer needed as current <br /> models are quieter according to the landscapers' association; and <br /> WHEREAS, deleting the expanded times and higher decibel levels for leaf blower <br /> operation would make them subject to general noise time restrictions and decibel limits (see <br /> Municipal Code §9.04.070), which will benefit residents' quiet enjoyment in their homes, as well <br /> as support the General Plan Noise Element provision regarding reducing outdoor noise levels <br /> in existing residential areas (see Policy 2). <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br /> HEREBY ORDAIN AS FOLLOWS: <br /> Section 1. Finds that the amendment to the Municipal Code has no possibility to have <br /> a significant effect on the environment per Title 14 California Code of Regulations§15061(b)(3). <br /> Section 2. Amends the Municipal Code by deleting Section 9.04.045 Leaf Blowers: <br /> A. Weekdays. <br /> 1. On Monday through Friday, no person shall operate a motor <br /> - .. -:'' ::99 <br /> 2. On Monday through Friday, between the hours of 6:00 a.m. and <br /> 8:00 a.m. no person shall operate a motor powered leaf blower unless the city <br /> than 73 dBA at full throttle at 50 feet. <br /> B. Saturday, Sunday and Holidays. <br /> 1. On Saturday, Sunday and holidays, no person shall operate a <br /> motor powered leaf blower between the hours of 10:00 p.m. to 7:00 a.m. <br /> 2. On Saturday, Sunday and holidays, between the hours of 7:00 a.m. <br /> has determined that the model in use cannot generate greater than 73 dBA at 50 <br />
